These general conditions of use and legal information (hereinafter, the “General Conditions”), apply to the website of “GRUPO CORELLIA PROYECTOS GASTRONOMICOS, S.L.” (hereinafter, the “Corporation”), called Service Club (hereinafter, “Service Club” ) whose domains are www.serviceclub.com & app.serviceclub.com, & https://www.serviceclub.es and the corresponding mobile application, as well as all its related or linked sites, as well as its affiliates and associates, including the websites of Service Club worldwide (hereinafter and collectively, the “website“).

The “website” is the property of “GRUPO CORELLIA PROYECTOS GASTRONOMICOS, S.L.” By using the “website”, you state your agreement (the term “you” or “your” refers to a user of the Platform) with these terms of use and agree to comply with them. Therefore, as the “Corporation”, we request that you carefully read the “General Conditions” and ensure that you understand and accept them before subscribing, accessing or using the Platform. If you do not agree, we ask you to refrain from using it or accessing it.

Through these “General Conditions“, “GRUPO CORELLIA PROYECTOS GASTRONOMICOS, S.L.” makes available to all those people in the hospitality and delivery sectors and are registered in the Service Club Platform, (hereinafter, the “Clubber“) the website and the mobile application (hereinafter collectively referred to as the “Platform”).

In accordance with the provisions of current regulations, the following identifying data of the owner of the “website” are presented:

0. DEFINITIONS AND INTERPRETATIONS

The following terms will have the meanings and interpretation as detailed below, unless the context clearly indicates otherwise:

  1. The Corporation; named “GRUPO CORELLIA PROYECTOS GASTRONOMICOS, S.L.”, encompasses a series of initiatives related to hospitality and delivery. The Corporation is specialized in training and recruitment of workers in the hospitality and delivery industries, as well as several other projects that will aim to increase the profitability and success of restaurants, hotels and delivery companies around the world.
  2. Service Club; refers to the online marketplace of hospitality and delivery workers and jobseekers, created by the “Corporation” where jobseekers can register, complete their profiles, apply for jobs, have access to online training and have their details shared with hospitality and delivery hirers.
  3. Service; refers to the service that the Corporation and the Service Club offer both Companies and Clubbers, which is simply matching profiles inside the marketplace and putting them in contact.
  4. Platform; refers jointly to the website and the mobile application.
  5. Website; collectively referred to as Service Club websites worldwide.
  6. Clubbers; refers jointly or individually to those people who work in the service/delivery industry or seeking work in service/delivery industry and are registered within the Service Club platform, online trained through microlearning and put in contact with hospitality/delivery business owners and managers (those defined below as Companies)
  7. Companies; refers jointly or individually to all restaurants, hotels, delivery companies, online retailers, post offices, flower shops or other establishments in which Service Club Clubbers work.
  8. Users; refers jointly or individually to Companies and Clubbers that are registered in the Service Club Platform and make use of an Account.
  9. Status; refers to the availability of the Clubber that may appear on the Platform as available or not available.
  10. Corellians; all the staff and workers that work internally in the Corporation, such as CEO, COO, CBO, CFO, CTO, Finance, Sales, Account Management, Hiring Success Managers, Owners and Product Managers, Developers, Technology, Administration, IT, Marketing, etc.
  11. The Parties; refers jointly to the Users and the Service Club, as indicated by the context.
  12. Service Club Membership; refers to the status of a Clubber inside the Platform depending on how much information he/she entered, how many training modules he/she completed and how many badges he/she collected with good and bad behaviour.
  13. Job Application; refers to Clubber applying for a job posted in the Platform by answering accurately the “To Quality” questions.
  14. To Qualify Questions; refers to a series of Yes / No questions that the Clubbers answers in order to qualify to apply for a specific job posted in the platform. The Clubber is obliged to answer these questions accurately and to commit to his/her answers post application.
  15. Service Club Onboarding; refers to the process in which Clubbers receive their induction and contract for their new Company from Service Club. Service Club makes the Clubber ready to start working on behalf of the Company.
  16. Company Onboarding; refers to Companies’ own systems to make their new workers ready to start working and may include equipment provision, induction and signature of contracts.
  17. Service Club Academy; refers to the microlearning skills academy created by Service Club and available to Clubbers from inside the platform;
  18. Microlearning modules; refers to the online training Clubbers receive from Service Club platform under the Academy. They are not obligatory though they increase jobseeker’s chance to be offered jobs by Companies. They are short, fun, question based online modules on Hospitality Basics, Hospitality Advanced, Delivering like a PRO, Job Hunting, Become an Entrepreneur, Career Development, Wellbeing, Social Awareness, Soft Skills, Productivity. They are not designed to give a full education on the subject but more designed to offer the applicant an introduction session as well as testing the applicants’ existing knowledge as well as to filter them. At the end of each module, the jobseeker can download a certificate.
  19. Service Club Competitions; refer to a series of competitions Service Club will conducts throughout the year to increase the number of Clubbers in the platform and increase their engagement within the platform. These competitions are not in collaboration with any Company though they intend to increase the traffic not only in Service Club platform but also in Company platforms.
  20. Service Club Forum; refers to the part of the website where Clubbers are free to share news, blogs, information or views about the Delivery or Hospitality Industry, and hold conversations with each other.
  21. Engagement; acceptance of a freelance or contract job Application of a Clubber by the Company and the subsequent relationship between the Clubber and the Company. The corporation acts only as a marketplace in where “Companies” and “Clubbers” meet each other. The corporation does not act, decide or participate, in any of their potential labor relationships.
  22. Matches; known as those Clubbers who match with the job posting of the Company with a certain percentage and are presented to the Companies.
  23. Recommended 3rd Party Suppliers; refers to those organisations that provide complementary services to Service Club’s and are recommended to Clubbers inside the platform in order to help them complete their legal papers and qualify for job.
  24. Confidential information; Any information or matter that is not in the public domain and that is directly or indirectly related to the Corporation, the Service Club, the Companies and/or any other legal entity with which the Clubber has had contact, in general, any information to which the Clubber has had access as a consequence of and in relation to the content of the Engagement and the operations or actions that are carried out in the execution thereof.
  25. Your Content; refers to the following Clubber information: profile photo, age, sex, nationality, education, health, language, address, telephone number, proof of work permit, proof of drivers license, proof of address, any insurances, proof of criminal record check, email, information regarding Social Security.
  26. Community Rules; a set of rules introduced by Service Club under which Users must self-regulate their engagement inside the platform. Community Rules are published in Service Club websites.
  27. Contact Form; refers to the contact details provided previously; [email protected] and https://serviceclub.com/contact-the-team/.

 

1. OBJECT

“Service Club” is marketplace of hospitality and delivery professionals or jobseekers created by the “Corporation” where jobseekers can register, complete their profiles, apply for jobs, have access to online training and have their details shared with hospitality and delivery hirers.

Service Club’s” intention is to match jobs with jobseekers and put parties that are interested in each other in contact (all hereinafter understood as the “Service”). The “Clubber“, can apply to any offer of the “Platform” registered by the “Companies” through the “Platform”, with “Service Club” acting as the marketplace that connects parties. Therefore, “Service Club” cannot and does not assume any responsibility such as, and not limited to, the conditions of the labor relationship, the payment of salaries to the “Clubbers“, the fulfilment of their fiscal obligations, the expenses that may have been incurred to reach such jobs, the breach of labor rights, the behavior of the “Company” or the “Clubber”, among others.

In this same way, “Service Club” acts as a brokerage platform by virtue of a mandate granted by the “Companies” through which potential workers can be filtered and selected. The objective of “Service Club” is to assist “Companies” who need freelance or contract workers at short notice with the filtering and selection of ”Clubbers”, willingly and voluntarily complying with the mandate given by the “Companies” to “Service Club”.

 

2. CAPACITY

Only people with legal capacity and sufficient legitimacy to accept legally binding contracts, and who can legally perform any employment under the applicable laws and regulations, may use the “Platform“. Persons who are not competent to enter into a contract, including those minors under applicable law, are not eligible to use the “Platform

By accessing/using the “Platform” or the “Services“, you declare and guarantee to “Service Club” that you are of legal age, fully competent to enter into a contract, and that you have capacity to accept and comply with these “General Conditions“.

If you are accessing/using the “Platform“/”Services” on behalf of a company or any other legal entity, you represent and warrant that you have the authority to bind such company or legal entity and in such case, the terms “you” and “your” in these “General Conditions” will refer to said company or entity. If you do not have such authority, you may not accept the “General Conditions” and you should not use the “Platform”.

You also declare and guarantee to “Service Club” that you will use the “Platform” in accordance with each and every one of the applicable laws and regulations. “Service Club” reserves the right to suspend access to the “Platform” if it is notified or if it is discovered that you are not competent to enter into the contract.

 

3. REGISTRATION

To access the “Platform“, you must register and create an account (Clubber Account”). For this you have the option to link your Facebook or Google-Connect account. We will not collect, store or save your Facebook or Google passwords. Other emails and passwords will be stored.

To register and activate your “Clubber Account”, you will also be asked to provide certain personal information to “Service Club, such as name, contact information, current location, proof of work permit, freelancer registration documents, criminal record disclosure, driver’s license, motor insurance, social security number, among others. If you do not provide us with all the information required during the registration and activation process, we may not be able to provide you with our “Service“. Although we are not your Company and are a marketplace, the information is required to help Companies speed up their filtering, selection and hiring process.

The details of the information we collect and how we use, store, transfer or disclose this information are detailed in our Privacy Policy available both in the Application and on the website www.serviceclub.com, which is an integral part of these “General Conditions“. If these “General Conditions” have been read in conjunction with our Privacy Policy and you do not consider them acceptable, please do not access or use the “Platform“.

Membership of “Service Club” marketplace is free of charge for “Clubbers”. Registering in “Service Club” will mean that your data will be shared with the “Companies” and your profile will be matched with the appropriate jobs. Clubber details will only be shared with an Company if the Clubber applied to one or more of their jobs. The “Clubber” will have the right to appear invisible in the “Platform” by adjusting their “State“.

Registering in “Service Club” marketplace and applying for jobs does not imply, in any instance, that Service Club is obliged to present your profile to Companies. Registering in “Service Club” marketplace and applying for jobs does not imply, in any instance, that any Company is obliged to provide you with work.

The “Clubber” guarantees that all the information about their identity and legitimacy provided to “Service Club” in its registration forms and “Platform” is true, accurate, complete and up to date. The “Clubber” also agrees to keep all information updated.

Service Club is not liable to check the authenticity of the information and documents provided by the Clubber. Service Club is not liable to see and verify the originals of the documents uploaded into the system.

If the “Clubber” provides false, inaccurate, inappropriate or incomplete information, or if “Service Club” considers that there are sufficient reasons to doubt the veracity, accuracy or integrity thereof, “Service Club” may deny access and current or future use of the “Platform” or any of its contents and/or services.

When registering on the “Platform“, the “Clubber” will select a username and a secure password. Both the username and password are strictly confidential, individual and non-transferable and the “Clubber” will be solely and totally responsible for all the activities carried out with their password or account, including statements made on the “Platform“, even if they are not authorized by the “Clubber“. “Service Club” has no control over the use of the “Clubber” account and expressly waives any liability arising therefrom. The “Clubber” agrees not to disclose information related to their account or make it accessible to third parties.

Once you have logged in and provided all the required information, your “Clubber Account” will be sent to Service Club admin for approval. It will take maximum 48 hours for your profile to be approved or rejected.

Clubbers” must immediately notify “Service Club” about the loss, withdrawal and/or disclosure of their username or password via email to “Contact Form” mentioned above, with the subject of the email being “Account-Unauthorized access”. If you suspect that an unauthorized person may be using your password or account or if you suspect any other security breach regarding your account, you should contact “Service Club” immediately and change your password without delay.

Service Club” reserves the absolute discretion to allow, or not, the creation of a “Clubber Account” and/or making use of any of the “Services”, without the need for any justification.

Your “Clubber Account” will remain active until cancelled in accordance with these “General Conditions” and, in the event of such cancellation, your right to access or use the “Service” will automatically cease unless you reinstall the Application or reactivate your “Clubber Account“.

Once the account is activated, depending on how much information you provide in the account and how many of the training modules you completed, you will be classified in one of the following levels:

  • Starters (Basic information).
  • The Essentials (Basic information + Experience + Education + Languages).
  • The Masters (Basic information + Experience + Education + Languages + Legal Documents + Photo).
  • The Elite (Basic information + Experience + Education + Languages + Legal Documents + Photo + One or more online training modules completed).

Master and Elite Members will qualify to be presented to Companies as filtered leads / candidates. Starter and Essential Members will be considered as unfiltered leads and they will only be presented to Companies that posted a standard job and requested unfiltered leads from Service Club. The “Clubber” may also gain more visibility in the platform by completing more than one training modules, by following Service Club social media, by contributing to newsfeed, by receiving positive feedback from Companies. All these earn a badge for the Clubber and improve their ranking in the platform. Equally, negative behaviour and feedback and impact their ranking adversely.

Classification of Behaviors

I. Positive behavior will be considered as:

  1. Profile completed.
  2. Microlearning modules of the Academy taken and passed.
  3. Completing 20, 50 or 100 trips for Companies in any given timeframe.
  4. Winning a Service Club Competition.
  5. Sharing eligible content to be published inside platform.
  6. Sharing “Service Club” on external social network.
  7. Acceptance of job offers.
  8. Positive feedback received from “Companies“.
  9. Positive feedback received by “Service Club“.
  10. Inviting a friend to join “Service Club“.

II. Negative behavior will be considered as:

  1. Failing to onboard to a job that you applied
  2. Arriving late to a job or interview accepted.
  3. Receiving negative feedback from “Companies“.
  4. Receiving negative feedback from “Service Club”.
  5. Any other serious misconduct.

Service Club” may suspend or cancel your “Clubber Account” at any time without prior notice if we suspect that any information you have provided is false, inaccurate, or incomplete, or if it is discovered that you are not complying with any of the these “General Conditions“.

You declare and confirm that you will not create more than one “Clubber Account” and if we disable your “Clubber Account” for any reason, you will not create another without prior notification. Only with our express authorization can you create another account.

 

4. SERVICES AND EQUIPMENT

The “Clubber” is responsible for having means or equipment that allow access to the Internet to access the “Platform“. In case of any incident or difficulty accessing the “Platform“, the “Clubber” must notify “Service Club” through the “Contact Form“, who will analyze the incident and advise the “Clubber” on the best way to resolve the problem.

Service Club” is a community of hospitality and delivery professionals; it does not control nor is responsible for the content that the “Clubber” or “Company” publishes in the “Platform“, with the parties being solely responsible for the legal adaptation of said content.

Service Club” marketplace will not be responsible for any service failure, connection errors, lack of availability or service deficiency in terms of Internet access, or for interruptions in the Internet network or for any other reason that is beyond their control.

Service Club” is not responsible for any security errors that may arise, nor for damages to the computer systems (hardware or software) of the “Clubber” or to the files and documents stored in them, as a consequence of:

  • The presence of a virus in the computer system or mobile device that the “Clubber” uses to connect to the services and content of the “Platform“.
  • Browser malfunction.
  • The use of versions of the same that have not been duly updated.

“Service Club” system will send notifications and emails about jobs, Companies, Clubbers, news and offers, directly about Service Club or relevant 3rd parties. Users can change notification settings inside the “Platform” if they do not wish to receive emails.

Service Club Membership” is free of charge for Clubbers. It is expected that the “Clubbers“, before starting to look for job offers, taking training and engaging in Service Club Forum, have adopted the terms in this document.

Taking microlearning modules and obtaining certificates from “Service Club” is free of charge for “Clubbers“. The certificates will be valid for the period of ONE (1) YEAR. After that period of time, the “Clubber” may be asked to perform a small test in order to keep their certificates in force.

In the event that “Service Club” considers that there is any reason to believe that the “Clubbers” are not following the learnings of the microlearning modules taken, they may be asked to retake those relevant modules.

Service Club is not responsible from obtaining insurances for Clubbers. It is the “Clubbers” responsibility to obtain necessary insurances required by the Companies.

Service Club is not responsible from obtaining work permits for Clubbers. Service Club is not responsible from obtaining freelancer registration for Clubbers. However, if you need advice on these matters, we may, from time to time, refer you to Recommended 3rd Party Suppliers who can handle such requirements. We would do this referral on “recommendation only” basis. Service Club is not responsible from the 3rd party suppliers’ operations. Nor will they handle relationship management between the Clubber and the 3rd Party Suppliers. Clubbers are therefore strictly advised to read the individual terms and conditions of these 3rd party suppliers before agreeing to receive their services.

Service Club will conduct a series of competitions for Clubbers throughout the year to increase the number of Clubbers in the platform and increase their engagement with the platform. “Service Club Competitions” are not in collaboration with any Company though they intend to increase the traffic not only in Service Club platform but also in Company platforms. Service Club reserves the right to decide the number of competitions it will conduct every year as well as the prize for each. Only Clubbers that fulfil the requirements of a particular competition and those complete the tasks required by a competition can take part. Each competition will have its own terms and these terms will be published in the web page related to the competition in question. Although some competitions will aim to increase applicants for a particular Company, the Clubber accepts that these competitions are not organised in collaboration with any Company and therefore, any communication, query and complaint regarding a particular competition must come directly to Service Club.

 

6. USER INFORMATION

You accept and acknowledge that “Service Club” may access, store and disclose any information you provide when registering (or in your registration request) or when using the “Platform“, if required by law or if in good faith it considers it necessary for legal purposes; for the fulfilment of these “General Conditions“; to respond to claims based on the violation of the rights of third parties; to respond to customer service inquiries or protect the rights, property or security of “Service Club” and our users.

Users can edit, at any time, the content and information they publish on the “Platform“, including, among others, their curriculum, profile, photos, news and publications, attachments, links, sources and experiences. Users can also edit the visibility of such content and appearance information to other users of the “Platform“. All the information you provide to us is protected and subject to our Privacy Policy, which is published and available on the “Platform“.

 

6. USER CONTENT

Any content, data or information that you submit, upload, display or share through the “Platform” (“Your Content“) will be your exclusive property. “Service Club” will not be responsible for any of your content shared with other Users of the “Platform” nor of copies thereof made and/or stored by said other users.

Similarly, any content, data or information that Companies submit, upload, display or share through the “Platform” will be their exclusive property. “Service Club” will not be responsible for any of User content shared with other Users of the “Platform” nor of copies thereof made and/or stored by said other users.

By accepting these “General Conditions“, you automatically grant “Service Club” a nonexclusive, irrevocable, worldwide, permanent, unlimited, assignable right, with permission to copy, reproduce, translate, adapt, store, publish, display, issue copies or communicate and/or use, process or analyze “Your Content“, in any way that is known now or discovered in the future, and prepare works derived from, or incorporate them into other works, without the need for any other type of consent, notification and/or compensation for you

You hereby accept and irrevocably authorize that “Service Club” has the right to use and retain for its own purposes, any information provided by you in relation to the “Platform“, and/or transmit said information to any other associated company or interested third party.

By reading the present “General Conditions” you declare that you understand that you provide us with “Your Content” at your own risk of loss. By providing us with the “Content“, you declare and guarantee that you have the necessary rights and/or permission to provide it, that it is not confidential and does not violate any law, contractual constraints or rights of third parties (including intellectual property rights).

Service Club” has no obligation to review communications or information in advance and is not responsible for the selection or monitoring of any “Content” published on the “Platform“ including inside “Service Club Forum”. However, “Service Club” may review, edit and/or remove any of your “Content” that, at its sole discretion, violates these “General Conditions“, violates applicable laws, rules or regulations, is offensive or illegal, or damages the reputation of “Service Club” or its “Platform“, or violates the rights of, or harms or threatens the safety of, users. Service Club may also remove any reported content by a 3rd party that is against our “Community Rules”. The author of any content that is against our Community Rules may also be removed from Service Club immediately and irreversible depending on the severity of the breach. If you identify such content posted by another User, you must report it to your Service Club Account Manager immediately.

 

7. GEOLOCALIZATION

Service Club” may collect, use and share data related to the location, including geographic location in real time, from the computer or mobile device of the “Clubber“, only if the “Clubber” has previously authorized this. This location data can be collected and used by “Service Club” to show the location of the “Clubber” regarding the proximity to the “Company“. Therefore and by accepting these “General Conditions“, the “Clubbers” give their express consent for their geolocation data to be shared with the “Companies” in order to ensure the success of the service. The “Clubber” may opt to disable their geolocation services on their devices in accordance with what is detailed in the Privacy Policy.

 

8. OBLIGATIONS AND RESPONSIBILITIES OF THE CLUBBER

The “Clubbers” are fully responsible for access and correct use of their profile and any other content of the “Platform“, subject to current legislation, whether national or international of the country in which it is used, as well as the principles of good faith, ethics, customs and public order. Specifically, the user agrees to respect these “General Conditions“.

The “Clubbers” must refrain from using their profile and any other content of the “Platform” for illicit purposes or for purposes that damage the rights and interests of third parties, or that may cause damage, disable, deteriorate or have a detrimental effect on the “Platform“, its content and its services. Likewise, it is prohibited to prevent the normal use or enjoyment of the “Platform” by other “Clubbers”.

Service Club” disclaims editorial responsibility and expressly declares that it does not identify with any of the opinions published by the “Clubbers” in the “Platform“, with the “Clubbers” being exclusively responsible for the consequences that may arise from said publication. In any case, and to protect the reputation of the “Corporation“, it is strictly prohibited for the “Clubbers” to publish derogatory or defamatory statements about the “Corporation“, the “Platform“, the Corporation’s personnel, the Administration, the “Companies“, other “Clubbers“, suppliers and distributors, and other affiliates and/or interested parties. Such publications may lead to the closure of the account or even the filing of some legal action.

Clubbers” should avoid communications on social networks that may be misinterpreted in ways that could damage the reputation of the “Platform” and/or the “Corporation“, either directly or indirectly. In this sense, the “Clubber” will promote at all times the best interests and reputation of “Service Club” to all third parties. The “Clubber” will not perform any action that, in the opinion of “Service Club“, may harm the reputation and interests of the latter. This includes, but is not limited to, speaking badly of “Service Club” to a “Company” or a third party, in any medium, either through social networks, online, through correspondence or verbally.

Those “Clubbers” that do not comply with these obligations shall be liable for any claims for damages. Under no circumstances will “Service Club” be responsible for any damage or injury that is due to illegal access or use by third parties. When there is damage caused by the declarations, actions or omissions of a “Clubber” that entails the loss of income of “Service Club“, the “Clubber” undertakes to compensate “Service Club” in full.

The “Clubber” accepts and agrees, by way of example, but not limited to, to the following:

  • To acknowledge and fully abide with the content of the Staff Handbook and Community Rules which are available on Service Club websites.
  • Not to apply to or accept a “Service Club” job that you know is out of your capability due to lack of specialized knowledge or skills.
  • To have the availability section of your profile updated at all times. If marked as “Unavailable”, the “Clubber” will still be able to see the jobs and apply but their profile will not be visible to the possible “Companies“. If marked as “Available”, you will receive job offers according to your preferences.
  • To not to alter or modify, totally or partially, the “Platform“, cancelling, deactivating or manipulating any function or service in it.
  • To not infringe any right of industrial and intellectual property or the rules of protection of personal data.
  • To not use the “Platform” to slander, defame, intimidate or harass other users, or damage their image. Do not access the email accounts of other “Clubbers” or “Companies“.
  • Not to load computer viruses, damaged files or any other program that may cause damage or alterations in “Service Club” or in the content and systems of third parties.
  • To not send mass emails to a large number of people or pass email addresses to third parties without prior consent.
  • To not advertise products or services without the prior consent of “Service Club“. Not to use “Service Club”platform for their commercial gain, to create and market their own business, or any other business.
  • Their details (excluding contact details) to be shared in Service Club newsfeed, website, social media or via other means of communication for marketing purposes.
  • Amicably resolve/settle any conflict between themselves and other users of the “Platform”, whenever required. “Service Club”reserves the right, but has no obligation, to monitor disputes between “Platform” users;
  • Respond to all emails or notifications from “Service Club”promptly;
  • Assume all risks associated with dealing with other users of the “Platform”, with whom you come in contact through the “Platform”;
  • To not use the “Platform” in order to host, display, upload, modify, publish, transmit, update, distribute, share, store or destroy any information or threaten the unity, integrity, defense, security or sovereignty of any nation, friendly relations with foreign states or of public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or insulting of any nation;
  • Not use any other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the “Platform”, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the “Platform”.

The “Clubber“, in case of having proof of non-compliance with the provisions of the “General Conditions“, must inform “Service Club“. All “Clubbers” must also inform “Service Club” of any abuse or violation of these conditions by email through the “Contact Form”. “Service Club” will review said notification as soon as possible and will adopt the measures it deems appropriate, reserving the right to withdraw and/or suspend any User from the “Platform” for the breach thereof. “Service Club” also reserves the right to remove and/or suspend any message with illegal or offensive content, without the need to give a prior warning or subsequent notification.

 

9. COMPLAINTS POLICY

All complaints regarding Service Club must be sent to [email protected].

We will acknowledge your complaint on the same day and aim to resolve within 7 days.

Certain complaints may require detailed investigation; in those cases, we will give you an update in 48 hours and will set, where possible a new deadline to respond.

 

10. JOB APPLICATIONS & REALIZATION OF “ENGAGEMENT”

By applying for a Job and/or accepting an “Engagement“, the “Clubber” confirms that they will:

  • Complete their profiles fully and aim to reach at least Master Level in memberships.
  • Provide all the documents requested by each job.
  • Make sure all information and documentation provided during the registration process are accurate, legitimate and appropriate. Service Club reserves the right not to approve a profile and/or delete it completely if we suspect the accuracy of an information or document or find them inappropriate for public use.
  • Make sure that any replacement information and document provided after the registration process are accurate, legitimate and appropriate. Service Club reserves the right not to approve a profile and/or delete it completely if we suspect the accuracy of an information or document or find them inappropriate for public use.
  • Answering all “To Qualify Questions” accurately in job posts. Service Club reserves the right not to approve a job application and/or delete it completely if we suspect the accuracy of an information or document provided during the job application. If we suspect that the Clubber repeatedly provides incorrect information during job applications, we reserve the right to delete the Clubber profile completely.
  • Take the microlearning modules available in Service Club Academy.
  • Take part in Service Club Competitions.
  • Act according to the contents of the Staff Handbook and Community Rules. If there is contradicting information with the Staff Handbook and these Terms and Conditions, these Terms and Conditions override those terms in the Staff Handbook.
  • Carry out the duties and responsibilities that are required of the “To Qualify Questions” of the job post and the “Engagement“.
  • Not designate any other person to perform the service.
  • Cooperate with the instructions of the “Company” and accept the direction, supervision and control of any responsible person within the organization of the “Company“.
  • Obey the rules, policies and/or relevant regulations of the “Company“, including, among others, their health and safety policies.
  • Comply with the dress code, if any, and with the “Company’s” code of conduct.
  • Act by taking the measures required to safeguard their health and safety and that of all those who are present, as well as those who are not present, and may be affected during the implementation of the “Engagement.
  • Understand that the service to be carried out will be characterized by the following Code of Ethics:
    1. Exceptional customer service.
    2. Friendly and pleasant attitude.
    3. Positive and helpful attitude.
    4. Honesty & Integrity.
    5. Speed & Punctuality.

12. FOOD HYGIENE

Service Club” undertakes to comply with the highest standards of health and hygiene. You must immediately notify “Service Club“, or the “Company” if you are already hired, if you have an illness or infection that precludes you from working with food. Likewise, you must guarantee that, during the time in which you suffer from said illness or infection, you will not request the performance of any task or any “Engagement” that requires handling or direct contact with food.

 

13. DISCIPLINARY MEASURES

In case of breach of any of the terms of these “General Conditions“, the “Clubber” could be subject to disciplinary actions by “Service Club” which may result in the termination of the contractual relationship:

Performance problems in your duties with the Company – including but not limited to – :

  • Non-compliance with the established objectives.
  • Absenteeism.

Occasional minor offenses – including but not limited to -:

  • Rude behavior.
  • Minor faults at work.
  • Breach of dress code/open door policy, etc.
  • Involuntary discrimination.

Serious misconduct/Repeated minor faults – including but not limited to -:

  • Lack of Company to advice and corrective actions.
  • Bad behavior in front of Companies, customers or colleagues.
  • Non-compliance with health and safety standards.
  • Please note that in some cases the contractual relationship may be terminated without prior written notice. Unacceptable behavior or gross misconduct will result in the immediate termination of the contractual relationship. Examples of unacceptable behavior include the following:
  • Corruption / Bribery
  • Breach of commitment
  • Harassment / Voluntary discrimination
  • Violence at work
  • Embezzlement / Fraud
  • Drug abuse
  • Violation of “Company” policies and procedures including these terms and conditions
  • Abusive or offensive language
  • Sending someone else for the jobs they are allocated inside the platform or by the Company
  • Uploading fake documentation
  • Uploading inappropriate information, images, videos or documentation
  • Entering images, videos or documentation inside the platform that are damaging for Service Club’s or one of its Companies’ reputation (defamation)
  • Using Service Club platform and its Forum in a way that breaches Community Rules
  • Entering false information
  • Entering friends and/or people they have not worked with in the past as referee

Make sure all information and documentation provided during the registration process are accurate, legitimate and appropriate. Service Club reserves the right not to approve a profile and/or delete it completely if we suspect the accuracy of an information or document or find them inappropriate for public use. Depending on the nature of the information or document, in some cases, we reserve the right to report the Clubber to the relevant authorities.

 

14. THIRD PARTY WEBSITES

The “Platform” may include hyperlinks to third party websites, which websites are outside the control of “Service Club”. If you click on one of these links you will leave the “Platform” and will be accessing a third party site. “Service Club” does not verify, monitor or endorse these third party websites or the products/services that are available or advertised or sold through these third party websites and does not accept any responsibility or liability for the authenticity, reliability, accuracy of the information therein or any loss or damage that you may incur by your visit and/or transactions/activities on these third party site(s). You agree that you access any such third party sites at your own risk and shall solely bear all consequences associated with your access to, and use of, such third party websites. Such third party sites may have separate terms and conditions and privacy policies and which are independent of “Service Club” and therefore, please read such third party terms before you access any such third party site.

 

15. INTELLECTUAL AND INDUSTRIAL PROPERTY

Service Club” is the owner and holder of the license that includes all the intellectual and industrial property rights included in the “Platform“, as well as the content that can be accessed. The intellectual or industrial property rights of the “Platform“, as well as all text, images, graphic design, browser structure, information and content pertaining to “Service Club“, which will be the holder of the exclusive right to exploit these rights in any way, especially the rights of reproduction, distribution, public communication and transformation, in accordance with the Spanish Law of Intellectual and Industrial Property.

The authorization granted in favor of the “User” to access the “Platform” does not imply the total or partial exemption, transfer, license or assignment of intellectual and industrial property rights by “Service Club“. The content of “Service Club” and its “Platform” cannot be deleted, omitted or manipulated in any way. It is also prohibited to modify, copy, reuse, exploit, reproduce, publicly communicate, make additional and subsequent publications, upload files, send by email, transfer, use, treat or distribute in whole or in part all the content included in both “Service Club” as well as in its “Platform” for public or commercial purposes without the express written authorization of “Service Club” and, if applicable, without the express written authorization of the owner of the corresponding rights.

The “Clubber” who shares any type of content or information through the “Platform” declares that they have the necessary rights to do so, with express waiver of “Service Club” with respect to any liability in relation to the content or legality of the information received. The availability of content by the “Clubber” through the “Platform” implies the transfer of the right of exploitation of the intellectual and industrial property derived from said contents to “Service Club“, free of charge and to the extent permitted by law.

 

16. UPDATING AND MODIFICATION OF THE PLATFORM

Service Club” reserves the right to modify these “General Conditions“, the Privacy Policy and the Cookies Policy at any time and without prior notice, so the “Clubber” must undertake to review them periodically. The “Clubber” must carefully read these “General Conditions” before accessing the “Platform“. In any case, the acceptance of them is an essential first step to access the services and content available in the “Platform“.

Service Club” also reserves the right, at any time and without prior notice, to update, modify or delete the information contained in its “Platform” in relation to its configuration, presentation and access conditions, without assuming any responsibility for the result. “Service Club” cannot guarantee the absence of interruptions or errors in the access to the “Platform” and its content, nor the fact that it has to be updated regularly. However, “Service Club” will do everything necessary to correct the errors, re-establish communication and update the content, unless there are reasons that make it impossible or difficult to repair, as soon as the error notification is received of the disconnection or of the need to update the content.

It is hereby agreed between the Parties that the “Clubber” will not be entitled to receive any amount from “Service Club” as compensation for losses suffered as a result of the termination of this agreement, regardless of the circumstances that motivate it.

 

17. DISCLAIMER OF WARRANTIES

You agree and acknowledge that the “Platform” and all information and services are provided on an “as is” and “as available” basis without any express warranties or representations.

“Service Club” is not responsible and makes no representations or warranties that the “Platform” and its services meet your expectations, nor that it functions without interruption or error in functioning. “Service Club” disclaims all liability for damages caused by and such interruption or error in functioning. Furthermore, “Service Club” disclaims all liability for any malfunctioning, impossibility of access or poor use conditions of the “Platform” due to inappropriate equipment, disturbances related to internet service providers or to the saturation of the internet network, and for any other reason.

“Service Club” makes no warranty that the “Platform” or any server through which you access the “Platform” is free of viruses or other harmful components. Any content or material downloaded or obtained through the use of the “Platform” is at your own discretion and risk and you are solely responsible for any damage to your computer system or loss of data that results from the download of such content or material.

“Service Club” makes no representations or warranties that there will be any minimum number of users with resumes or companies with job offers on the “Platform”, and that the information disclosed by the users with resumes or companies with job offers is accurate, up-to-date and reliable.

 “Service Club” makes no representations or warranties that any resume, job posting, news document, advertisement or other content or communication will be viewed by a minimum or defined number of users or by any specific user, and that your requirements or expectations on the quantity or quality of job applicants will be met.

 

18. TERM AND EXPIRY

The “General Conditions” will be binding from the moment you register and create a User Account and will remain in force until the expiration of your User Account.

You can cancel the use of the “Platform” and the application of this Agreement for any reason or no reason whatsoever by logging into your profile and deleting your profile completely.

Likewise, “Service Club” may terminate your activity on the “Platform“, as per this Agreement for any reason or no reason whatsoever, which includes, among others, a violation of the “General Conditions.

After the cancellation of your User Account, your right and license to access and/or use the “Platform” ceases immediately. Your login ID and password will be deactivated and you will no longer be able to access or use the “Platform“. In addition, your personal information will be treated in accordance with our Privacy Policy.

 

19. SERVICE CLUB LIABILITY

Service Club” acts as a broker between “Clubbers” and “Companies”. It performance consists basically in a marketplace platform that match up different delivery and hospitality professionals in accordance with their requirements.

According to the aforementioned, “Service Club” is not responsible in any case from the following circumstances:

  • From any dispute between “Company” and “Clubber”.
  • From “Clubbers”
  • From false information updated on the “Platform” by “Clubbers” or “Companies”.
  • From the accuracy of the information and the authenticity of the documentation loaded on the “Clubber’s” or “Company’s” profile.
  • From “Clubbers’” knowledge and skills. “Service Club” training just operates as a reference and it is not responsible from “Clubber’s” implementation once in the “Engagement”.
  • From the business insurances under which “Clubbers” need to be covered.
  • From “Clubbers”’ duty to have any mandatory insurance, such as “Food Delivery Insurance” or “Food Handling Insurance.”
  • From expired, inaccurate or forged documents that may have been provided by the “Clubbers”.
  • From “Clubbers”’ duty to have any mandatory training, such as “Food Handler Certificate”.
  • From any comment in social media made by “Clubber” or “Company” about their relationship.
  • From “Clubbers’” payments, taxes and other expenses made by the “Companies”.
  • From “Company’s” lack of payment or any breach of employment rights.
  • From any “Clubber’s” accident on the way to the “Engagement” and during its performance.
  • From any Recommended 3rd Party Suppliers’ actions and operations.
  • From any agreement between “Company” and “Clubber”.
  • From any comment or content left in our website that violates applicable laws, rules or regulations, is offensive or illegal, or damages the reputation of “Service Club” or its “Platform“, or violates the rights of, or harms or threatens the safety of, users.
  • From any other circumstances expressly stated in any of the clauses of these “General Conditions”.
  • Non-compliance with current regulations.

 

20. CONFIDENTIALITY

In order to preserve the confidentiality and trade secrets of any “Company” and “Service Club” and without prejudice to any other duty, you agree that, during and after any “Engagement“, you will not disclose (except in performance of your services during “Engagement“) or use for your own benefit or that of third parties, any “Confidential Information“. You also agree that, at any time, you will not make any copy, extract or summary, either in whole or in part, of any document or information belonging to the “Company” or “Service Club“, except when it is necessary to do so in the course of an “Engagement“, in which case said copy, extract or summary would be the property of the “Company” or of “Service Club“.

You agree to deliver to the “Company” the material provided by him or to “Service Club“, at the end of each “Engagement“, the documents, identification cards, equipment, passwords, access codes and any other material relating to it (with copies included) and that are in your possession.

You must also keep confidential information about the presence and behavior of those people you will be attending at the time of the “Engagement“.

This Clause does not apply to information that is in the public domain, or information not being considered as public domain but is known due to breach of this clause or due to the breach of any other obligation of confidentiality, or information whose transmission or disclosure has been ordered by competent courts or tribunals.

 

21. QUALITY AND MONITORING

During your application process, you may be telephoned by “Service Club”s in-house operators for screening. These calls are recorded and monitored for quality and training purposes. By applying a job with “Service Club” platform, you consent your calls to be recorded. If there is any reason why you do not wish to have your call recorded, please do tell this to the operator calling you at the beginning of the call.

 

22. SEVERABILITY

If any term included in these “General Conditions” is considered null or voidable, it will be rendered null and void. Such a declaration of invalidity shall not entail the invalidity of the rest of the Contract, with the same being applicable and binding on the parties.

In the event of conflict between these “General Conditions” and the “Privacy Policy”, the following order of precedence shall apply: (i) the “General Conditions“; (ii) these “Privacy Policy”.

 

23. APPLICABLE LAW

The relationship between “Service Club” and “Clubber” will be governed and construed in accordance with these “General Conditions” as well as in accordance with Spanish law. Any dispute arising in relation to these “General Conditions” will be resolved subject to the jurisdiction of the Judges and Tribunals of the city of Barcelona.

Las presentes condiciones generales de uso e información legal (en lo sucesivo, “Condiciones Generales”) regulan el sitio web de “GRUPO CORELLIA PROYECTOS GASTRONÓMICOS, S.L.” (en lo sucesivo, la “Sociedad”), denominada Service Club (en lo sucesivo, “Service Club”) cuyos dominios son www.serviceclub.com, app.serviceclub.com y https://www.serviceclub.es y la aplicación móvil correspondiente, así como sus sitios relacionados o vinculados, y sus empresas relacionadas y asociadas, incluidos los sitios web de Service Club en todo el mundo (en lo sucesivo y conjuntamente, el “Sitio Web”).

El “Sitio Web” es propiedad de “GRUPO CORELLIA PROYECTOS GASTRONÓMICOS, S.L.” Al utilizar el “Sitio Web”, usted manifiesta su conformidad (el término “usted” o “su” se refiere a un usuario de la Plataforma) con las presentes condiciones de uso y acepta cumplirlas. Es por ello que desde la “Sociedad” solicitamos que lea detenidamente las “Condiciones Generales” y se asegure de comprenderlas y aceptarlas antes de suscribirse, acceder o utilizar la Plataforma. Si no está de acuerdo, le rogamos que se abstenga de usarla o de acceder a la misma.

0. DEFINICIONES E INTERPRETACIONES

Los siguientes términos tendrán los significados y la interpretación que se detallan a continuación, a menos que del contexto se desprenda claramente lo contrario:

  1. La Sociedad; denominada “GRUPO CORELLIA PROYECTOS GASTRONÓMICOS, S.L.”, abarca una serie de iniciativas orientadas a la hostelería y los servicios de reparto. La Sociedad se especializa en la formación y contratación de trabajadores de las industrias de la hostelería y los servicios de reparto, así como en distintos proyectos destinados a aumentar la rentabilidad y el éxito de restaurantes, hoteles y empresas de servicios de reparto alrededor del mundo.
  2. Service Club; se refiere al mercado virtual, creado por la “Sociedad”, para trabajadores y personas que buscan empleo en las industrias de la hostelería y los servicios de reparto, en el cual las personas que buscan empleo pueden registrarse, completar sus perfiles, postularse a los empleos, acceder a formaciones en línea y compartir su información con el personal de selección de las industrias de la hostelería y los servicios de reparto.
  3. Servicio; se refiere al servicio que la Sociedad y Service Club ofrecen a los “Empresas” y “Clubbers”, el cual consiste simplemente en emparejar perfiles dentro del mercado virtual y poner a estos perfiles en contacto.
  4. Plataforma; se refiere conjuntamente al sitio web y la aplicación móvil.
  5. Sitio Web; referido colectivamente a los sitios web de Service Club en todo el mundo.
  6. “Clubbers”; se refiere en forma conjunta o individual a aquellas personas que trabajan en las industrias de la hostelería y los servicios de reparto, o a aquellas personas que buscan trabajar en esta industria y que están registradas en la Plataforma de Service Club, o que se les ha ofrecido una formación en línea a cargo de Service Club y se las ha conectado con propietarios o gerentes de las industrias de la hostelería  y/o los servicios de reparto (definidos a continuación como “Empresas”).
  7. Empresas; se refiere en forma conjunta o individual a todos los restaurantes, hoteles, empresas de reparto, tiendas en línea, oficinas de correos, florerías u otras tiendas en las que los “Clubbers” de Service Club trabajan.
  8. Usuarios; referidos de forma conjunta o individual a las “Empresas” y los “Clubbers” que están registrados en la Plataforma de Service Club y hacen uso de una Cuenta.
  9. Estado; referido a la disponibilidad del “Clubber” que aparecerá en la Plataforma como disponible o no disponible.
  10. Corellians; se refiere a todo el equipo interno de la Sociedad, tales como el CEO, COO, CBO, CFO, CTO, financieros, vendedores, gestores de cuentas, gerentes de contratación de talentos, propietarios y gerentes de producto, desarrolladores y colaboradores de los sectores de Tecnología, Administración, IT, Marketing, etc.
  11. Las Partes; referido conjuntamente a los Usuarios y al Service Club, según lo que indique el contexto.
  12. Membresía Service Club; se refiere al estado de un “Clubber” dentro de la Plataforma, según la cantidad de información que ingresa, el número de módulos de formación que completa y el número de medallas que obtiene según su buena o mala conducta.
  13. Solicitud de empleo; se refiere a la solicitud de un “Clubber” enviada en relación con un empleo publicado en la Plataforma, en la que contesta las “Preguntas para calificar” con información veraz.
  14. Preguntas para calificar; se refiere a una serie de preguntas de Sí o No que los “Clubbers” responden para calificar y poder enviar su candidatura para un empleo específico publicado en la plataforma. El “Clubber” está obligado a responder estas preguntas con información veraz y a comprometerse con la autenticidad de sus respuestas con posterioridad a la solicitud.
  15. Onboarding por parte de Service Club; se refiere al proceso mediante el cual los “Clubbers” reciben una inducción y el contrato de la nueva “Empresa” a través de Service Club. Service Club se encarga de preparar a los “Clubbers” para comenzar a trabajar en nombre de la “Empresa”.
  16. Onboarding por parte de la Empresa; se refiere al sistema propio de la “Empresa” para preparar a sus nuevos colaboradores antes de que comiencen a trabajar y que puede incluir la provisión de equipamiento, una inducción y la firma de contratos.
  17. Service Club Academy; se refiere a la academia de microaprendizaje de aptitudes creada por Service Club y disponible para todos los “Clubbers” desde la Plataforma.
  18. Módulos de microaprendizaje; se refiere a la formación en línea que se imparte a los “Clubbers” en la Plataforma a través de Service Club Academy. Si bien estos módulos no son obligatorios, aumentan las posibilidades de las personas en búsqueda de empleo de que las “Empresas” les ofrezcan puestos de trabajo. Son módulos en línea cortos, divertidos y basados en preguntas sobre el ABC de la hostelería, hostelería avanzada, cómo ser un repartidor profesional, búsqueda de trabajo, cómo convertirse en emprendedor, desarrollo de carrera, bienestar, conciencia social, habilidades sociales y productividad. Estos módulos no se diseñaron para brindar una formación completa sobre la materia, sino más bien para ofrecer al candidato una introducción al tema y poner a prueba sus conocimientos actuales, así como para preseleccionarlos. Una vez que se completa el módulo, la persona puede descargar un certificado.
  19. Competencias de “Service Club”; se refiere a una serie de concursos que “Service Club” llevará a cabo durante el año para aumentar el número de “Clubbers” en la Plataforma y para aumentar la participación dentro de la Plataforma. Estos concursos no se realizan en colaboración con las “Empresas”, a pesar de que su intención es aumentar el tráfico no solo en la Plataforma de Service Club, sino también en las plataformas de las “Empresas”.
  20. Foro de Service Club; se refiere a la sección del Sitio Web en la que los Clubbers pueden compartir libremente noticias, blogs, información o sus puntos de vista sobre las industrias de la hostelería y los servicios de reparto, así como mantener conversaciones entre ellos.
  21. Engagement; se refiere a la aceptación por parte de la “Empresa” de una Candidatura a un trabajo por cuenta propia o ajena de un “Clubber” y la relación resultante entre el “Clubber” y la “Empresa”. La Sociedad actúa solo como un mercado virtual en el que las “Empresas” y los “Clubbers” se conocen. La Sociedad no actúa, decide ni participa en ninguna de las posibles relaciones laborales entre estas partes.
  22. Coincidencias; es la denominación que se les da a los “Clubbers” que, con un determinado porcentaje, compatibilizan con la oferta de empleo publicada por la “Empresa”, y cuyos perfiles se le envían a la “Empresa”.
  23. Proveedores Externos Recomendados; se refiere a aquellas organizaciones que brindan servicios complementarios a los ofrecidos por Service Club y que se recomiendan a los “Clubbers” en la plataforma para ayudarlos a gestionar la documentación legal y calificar para un empleo.
  24. Información Confidencial; toda información o asunto que no sea de dominio público y que esté directa o indirectamente relacionado con la Sociedad, “Service Club”, las “Empresas” o cualquier otra entidad legal con la que el “Clubber” haya tenido contacto, en general, toda información a la que el “Clubber” haya tenido acceso como consecuencia de y en relación con el Contenido del Engagement y las operaciones o acciones que se lleven a cabo en el ejercicio de este.
  25. Su contenido; se refiere a la siguiente información del “Clubber”: foto de perfil, edad, sexo, nacionalidad, formación, salud, idioma, dirección, número de teléfono, prueba de permiso de trabajo, constancia de licencia de conducción, constancia de empadronamiento, seguros, constancia de antecedentes penales, correo electrónico, datos de la Seguridad Social.
  26. Reglamentos comunitarios; el conjunto de normas presentado por Service Club, según el cual los usuarios deben autorregular su engagement dentro de la Plataforma. Los Reglamentos comunitarios están publicados en los Sitios Web de Service Club.
  27. Formulario de contacto; se refiere a los datos de contacto detallados previamente; [email protected] y https://serviceclub.com/contact-the-team/.

 

1. OBJETO

“Service Club” es un mercado virtual, creado por la “Sociedad”, para trabajadores y personas que buscan empleo en las industrias de la hostelería y los servicios de reparto, en el cual las personas en búsqueda de empleo pueden registrarse, completar sus perfiles, enviar sus candidaturas, acceder a formaciones en línea y compartir su información con el personal de selección de las industrias de la hostelería y los servicios de reparto.

La intención de “Service Club” es emparejar empleos con personas en búsqueda de empleo y poner en contacto a las partes interesadas (en lo sucesivo, el “Servicio”). El “Clubber” puede enviar su candidatura para cualquier oferta que aparezca en la “Plataforma” que haya sido registrada por las “Empresas” en la “Plataforma” y en donde “Service Club” actúa como el mercado virtual que conecta a las partes. Por ello, “Service Club” no puede y no asume responsabilidad alguna, como las condiciones de la relación laboral, el pago de la remuneración a los “Clubbers”, el cumplimiento de las obligaciones fiscales, los gastos en los que se pueda incurrir para conseguir estos empleos, el incumplimiento de los derechos laborales, la conducta de las “Empresas” o del “Clubber”, entre otras.

Del mismo modo, “Service Club” actúa como una plataforma intermediaria en virtud del mandato concedido por las “Empresas”, por el cual están facultados para preseleccionar y seleccionar posibles colaboradores. El propósito de “Service Club” es brindar soporte a las “Empresas” que necesitan contratar a colaboradores por cuenta propia o ajena con poca antelación a través de la preselección y selección de los “Clubbers”, cumpliendo de forma deliberada y voluntaria con el mandato entregado por las “Empresas” a “Service Club”.

 

2. CAPACIDAD

Únicamente aquellas personas con capacidad legal y legitimación suficiente para aceptar contratos legalmente vinculantes, y que legalmente pueden realizar cualquier empleo bajo las leyes y regulaciones aplicables, pueden usar la “Plataforma“. Las personas que no sean capaces de contratar o de ser contratados, incluidas aquellas menores de edad según la ley aplicable, no se consideran aptas para usar la “Plataforma”.

Al acceder o utilizar la “Plataforma” o los “Servicios”, usted declara y garantiza a “Service Club” que es competente para contratar y que tiene el derecho, la autoridad y la capacidad para aceptar y cumplir con estas “Condiciones Generales“.

Si está accediendo o utilizando la “Plataforma” o los ”Servicios” en nombre de una compañía o cualquier otra entidad legal, usted declara y garantiza que tiene la autoridad para comprometer a dicha compañía u entidad legal y en cuyo caso, los términos “usted” y “su” en estas “Condiciones Generales” se referirá a dicha compañía o entidad. Si no tiene dicha autoridad, no debe aceptar las “Condiciones Generales” y tampoco debe utilizar la “Plataforma”.

También declara y garantiza a “Service Club” que utilizará la “Plataforma” de manera acorde a todas y cada una de las leyes y regulaciones aplicables. “Service Club” se reserva el derecho de suspender el acceso a la “Plataforma” si se le notifica o si descubre que usted no es competente para contratar.

 

3. REGISTRO

Para acceder a la “Plataforma”, debe registrarse y crear una cuenta (“Cuenta Clubber”). Para ello tiene la opción de vincular su cuenta de Facebook o de Google-Connect. No recopilaremos, almacenaremos ni guardaremos sus contraseñas de Facebook o Google. No obstante, sí se almacenarán los demás correos electrónicos así como las contraseñas.

Para poder registrarse y activar su “Cuenta Clubber”, también se le solicitará que proporcione cierta información personal a “Service Club”, como su nombre, datos de contacto, ubicación actual, constancia de inscripción como trabajador autónomo, constancia de antecedentes penales, licencia de conducción, seguro de vehículos, número de seguridad social, entre otros. Si no nos proporciona toda la información necesaria durante el proceso de registro y activación de su cuenta, es posible que no podamos brindarle el “Servicio”. Aunque no somos la “Empresa” y somos un mercado virtual, la información es necesaria para ayudar a las “Empresas” a acelerar el proceso de filtrado, selección y contratación.

Los detalles de la información que recopilamos y cómo utilizamos, almacenamos, transferimos o divulgamos esta información se detallan en nuestra Política de Privacidad disponible tanto en la Aplicación, como en el sitio web www.serviceclub.com, que forma parte integrante de estas ” Condiciones Generales“. Si las presentes “Condiciones Generales” han sido leídas juntamente con nuestra Política de Privacidad y no las considera aceptables, por favor no acceda ni use la “Plataforma”.

La membresía al mercado virtual de “Service Club” es gratuita para los “Clubbers”. Registrarse en “Service Club” implica que sus datos se compartirán con las “Empresas” y que su perfil se compatibiliza con trabajos que encajen con este. La información personal de un “Clubber” solo se compartirá con la “Empresa” si el “Clubber” envía su candidatura a uno o más de sus empleos. El “Clubber” tendrá el derecho de tener su perfil en modo oculto en la “Plataforma” si ajusta sus preferencias de “Estado”.

Registrarse en el mercado virtual de “Service Club” y postularse para los empleos no implica, bajo ningún concepto, que “Service Club” está obligado a presentar su perfil a las “Empresas”. Registrarse en el mercado virtual de “Service Club” y postularse para los empleos no implica, bajo ningún concepto, que las “Empresas” están obligados a ofrecerle trabajo.

El “Clubber” garantiza que toda la información proporcionada a “Service Club” respecto de su identidad y la veracidad de esta información en los formularios de registro y en la “Plataforma” es veraz, exacta, completa y actualizada. El “Clubber” también se compromete a mantener toda su información actualizada.

Service Club no será responsable de verificar la autenticidad de la información ni los documentos proporcionados por el “Clubber”. Service Club no será responsable de ver ni verificar los documentos originales de los archivos cargados en el sistema.

En el supuesto de que un “Clubber” proporcione información falsa, inexacta, inapropiada o incompleta, o si “Service Club” considera que existen motivos suficientes para dudar de la veracidad, exactitud o integridad de esta, “Service Club” podrá denegar el acceso actual o futuro a la “Plataforma” o a cualquier de los contenidos o servicios.

Al registrarse en la “Plataforma”, el “Clubber” seleccionará un nombre de usuario y una contraseña segura. Tanto el nombre de usuario como la contraseña son estrictamente confidenciales, personales e intransferibles y el “Clubber” será el único y totalmente responsable de todas las actividades que se realicen con su contraseña o cuenta, incluidas las declaraciones realizadas en la “Plataforma”, incluso si no cuentan con su autorización. “Service Club” no tiene control sobre el uso de la cuenta del “Clubber” y renuncia expresamente a cualquier responsabilidad derivada de la misma. El “Clubber” se compromete a no divulgar información relacionada con su cuenta o hacerla accesible a terceros.

Una vez que haya iniciado sesión y haya proporcionado toda la información requerida, su “Cuenta Clubber” será enviada a “Service Club” para su aprobación. Su perfil será aprobado o rechazado en un plazo máximo de 48 horas.

Los “Clubbers” están obligados a notificar de inmediato a “Service Club” sobre la pérdida, retirada y/o divulgación de su nombre de usuario o contraseña, a través de correo electrónico a “Formulario de Contacto” mencionado anteriormente, definiendo como asunto del correo electrónico “Cuenta-Acceso no autorizado”. Si sospecha que una persona no autorizada puede estar usando su contraseña o su cuenta o si tiene alguna sospecha de cualquier otra violación de seguridad con respecto a su cuenta, debe contactar inmediatamente con “Service Club” y cambiar su contraseña sin demora.

“Service Club” se reserva la absoluta discreción de permitirle o no, la creación de una “Cuenta Clubber” y/o hacer uso de cualquiera de los “Servicios”, sin necesidad de justificación alguna.

Su “Cuenta Clubber” permanecerá activa hasta que se cancele de acuerdo con los supuestos de estas “Condiciones Generales”, y en el caso de que esta cancelación ocurra, el derecho de acceder al “Servicio” cesará automáticamente a menos que vuelva a instalar la Aplicación o reactive su “Cuenta Clubber”.

Una vez que la cuenta se encuentre activa, y dependiendo de la cantidad de información que haya proporcionado en la cuenta y de cuántos módulos de formación haya completado, se lo clasificará en uno de los siguientes niveles:

  • Starters (información básica).
  • Essentials (información básica + experiencia + formación + idiomas).
  • Masters (información básica + experiencia + formación + idiomas + documentos legales + foto).
  • Elite (información básica + experiencia + formación + idiomas + documentos legales + foto + uno o más módulos completos de formación en línea).

Los miembros Master y Elite calificarán para que sus perfiles se presenten a las “Empresas” como interesados preseleccionados o candidatos. Los miembros Starter y Essential se considerarán como interesados no preseleccionados y solo se presentarán a aquellas “Empresas” que publiquen un empleo estándar y requieran a Service Club los interesados no preseleccionados. El “Clubber” también podrá ganar más visibilidad en la plataforma si realiza las siguientes acciones: completar más de un módulo de formación, seguir a Service Club en las redes sociales, contribuir en el muro de noticias, recibir valoraciones positivas de las “Empresas”. Todas estas acciones permiten al “Clubber” ganar medallas y mejorar su puntuación en la plataforma. De igual manera, las conductas y las valoraciones negativas serán desfavorables para su puntuación.

 

Clasificación de conductas

I. Se considerará comportamiento positivo:

  1. Tener el perfil completado.
  2. Realizar y aprobar los módulos de micro-aprendizaje de Service Club Academy. Colección de Puntos.
  3. Completar 20, 50 o 100 viajes para “Empresas” en un periodo determinado.
  4. Ganar uno de los concursos de Service Club.
  5. Compartir “Service Club” en redes sociales externas.
  6. Aceptación de ofertas de trabajo.
  7. Recibir valoraciones positivas de las “Empresas”.
  8. Recibir valoraciones positivas de “Service Club”.
  9. Invitar a un amigo a unirse a “Service Club”.

II. Se considerará comportamiento negativo:

  1. No incorporarse a un trabajo para el cual se postuló.
  2. Llegar tarde a un trabajo o entrevista acordado.
  3. Recibir valoraciones negativas de las “Empresas”.
  4. Recibir valoraciones negativas de “Service Club”.
  5. Cualquier otra falta grave.

“Service Club” podrá suspender o cancelar su “Cuenta Clubber” en cualquier momento sin necesidad de previo aviso si sospechamos que cualquier información que haya proporcionado es falsa, inexacta, no está actualizada o está incompleta, o si se descubre que está incumpliendo alguna de estas “Condiciones Generales”.

Usted declara y confirma que no creará más de una “Cuenta de Clubber” y si deshabilitamos su “Cuenta Clubber” por cualquier motivo, no creará otra sin comunicárnoslo previamente. Únicamente con nuestra autorización expresa podrá crear otra cuenta.

 

4. SERVICIOS Y EQUIPOS

El “Clubber” es responsable de tener los medios o los equipos que permitan el acceso a Internet para acceder a la “Plataforma”. En caso de cualquier incidente o dificultad al acceder a la “Plataforma“, el “Clubber” debe notificar a “Service Club” a través del “Formulario de Contacto”, quien analizará el incidente y aconsejará al “Clubber” sobre la mejor manera de resolver el problema.

“Service Club” es una comunidad de profesionales de la hostelería y los servicios de reparto que no controla ni es responsable de los contenidos que el “Clubber” o la “Empresa” publican en la “Plataforma”, siendo las partes las únicas responsables de cumplir con los requisitos legales para la publicación estos contenidos.

El mercado virtual “Service Club” no será responsable por las fallas en el servicio, errores de conexión, falta de disponibilidad o deficiencias en el servicio respecto al acceso Internet, o por las interrupciones en la red de Internet por cualquier otro motivo que esté fuera de su control.

“Service Club” no se responsabiliza de los errores de seguridad que puedan surgir, ni de los daños en los sistemas informáticos (hardware o software) del “Clubber” o en los archivos y documentos almacenados en ellos, que hayan sido a consecuencia de:

  • La presencia de un virus en el sistema informático o dispositivo móvil que el “Clubber” utiliza para conectarse a los servicios y contenido de “Plataforma”
  • Mal funcionamiento del navegador.
  • El uso de versiones del mismo que no hayan sido debidamente actualizadas.

El sistema de “Service Club” enviará notificaciones y correos electrónicos acerca de empleos, “Empresas”, “Clubbers”, noticias y ofertas, directamente en relación con Service Club o terceros relevantes. Los usuarios pueden cambiar la configuración de las notificaciones dentro de la “Plataforma” si no desean recibir correos electrónicos.

La “Membresía Service Club” es gratuita para los “Clubbers”. Se espera que los “Clubbers” acepten los términos del presente documento, antes de comenzar a buscar ofertas de empleo, realizar las formaciones y participar del Foro de Service Club.

Realizar los módulos de microaprendizaje y obtener los certificados de “Service Club” es una prestación gratuita para los “Clubbers”. Los certificados tendrán una validez de UN (1) AÑO. Después de este plazo, se le podrá solicitar al “Clubber” que realicé una breve prueba para mantener vigentes sus certificados.

En el supuesto de que “Service Club” considere que existe algún motivo para creer que los “Clubbers” no están implementando los conocimientos adquiridos en los módulos de microaprendizaje, se les podrá solicitar que vuelvan a tomar los módulos que se consideran relevantes.

“Service Club” no es responsable de la obtención de los seguros de los “Clubbers”. Es responsabilidad de los“Clubbers” obtener los seguros que requieren las “Empresas”.

“Service Club” no es responsable de la obtención de los permisos de los “Clubbers”. Service Club no es responsable de la inscripción como trabajador autónomo de los “Clubbers”. Sin embargo, si necesita asesoramiento en estas cuestiones, podríamos, oportunamente, referir a Proveedores Externos Recomendados que podrán ayudarle con estos requerimientos. Este contacto se haría como “solo una recomendación”. “Service Club” no es responsable de las operaciones de los Proveedores Externos. Ni será el encargado de la gestión de las relaciones entre el “Clubbers” y los Proveedores Externos. Por tanto, se advierte enfáticamente a los “Clubbers” que lean los términos y condiciones de cada Proveedor Externo antes de contratar sus servicios.

Durante el año, “Service Club” llevará a cabo una serie de concursos para “Clubbers” para aumentar el número de “Clubbers” en la Plataforma y para aumentar la participación dentro de la Plataforma. Las “Competencias de Service Club” no se realizarán en colaboración con las “Empresas”, aunque su intención no es solo aumentar el tráfico en la Plataforma de Service Club sino también en las plataformas de las “Empresas”. Service Club se reserva el derecho de decidir la cantidad de competencias que se celebrarán cada año, así como el premio de cada uno. Solo podrán participar los “Clubbers” que cumplan los requisitos de las competencias en particular y aquellos que completen las tareas necesarias para la competencia. Cada competencia tendrá sus propios términos y dichos términos se publicarán en el sitio web de la competencia en cuestión. Si bien algunos concursos tendrán el propósito de aumentar el número de candidatos para una “Empresa” específico, el “Clubber” acepta que estos concursos no se organizan en colaboración con ninguna “Empresa” y, por tanto, cualquier comunicación, pregunta o queja con respecto a un concurso en particular debe presentarse directamente a “Service Club”.

 

5. INFORMACIÓN DEL USUARIO

Usted acepta y reconoce que “Service Club” puede acceder, almacenar y divulgar cualquier información que proporcione al registrarse (o en su solicitud de registro) o al utilizar la “Plataforma”, si así lo exige la ley o si de buena fe lo considera necesario para fines legales; para el cumplimiento de estas “Condiciones Generales”; para responder a reclamaciones fundadas en la violación de los derechos de terceros; para responder a consultas de servicio al cliente o proteger los derechos, la propiedad o la seguridad de “Service Club” y de nuestros usuarios.

Los usuarios pueden editar, en cualquier momento, el contenido y la información que publican en la “Plataforma”, incluidos, entre otros, su currículum, su perfil, sus fotos, sus noticias y publicaciones, sus archivos adjuntos, sus enlaces, sus fuentes y su experiencia. Los usuarios también pueden editar la visibilidad de dicho contenido e información en relación con los demás usuarios de la “Plataforma”. Toda la información que nos proporcione, está protegida y sujeta a nuestra Política de Privacidad, que está publicada y disponible en la “Plataforma”.

 

6. CONTENIDO DEL USUARIO

Cualquier contenido, datos o información que envíe, cargue, muestre o comparta a través de la “Plataforma” (“Tu Contenido“) serán de su exclusiva propiedad. “Service Club” no será responsable de ninguno de sus contenidos compartidos con los demás Usuarios de la “Plataforma” ni de las copias de los mismos realizadas y/o almacenadas por dichos otros usuarios.

De igual manera, el contenido, los datos o la información que las “Empresas” envíen, carguen, muestren o compartan a través de la “Plataforma” serán propiedad exclusiva de las “Empresas”. “Service Club” no será responsable de ninguno de los contenidos compartidos con los demás usuarios de la “Plataforma” ni de las copias respectivas realizadas o almacenadas por otros usuarios.

Al aceptar estas “Condiciones Generales”, usted otorga automáticamente a “Service Club“, un derecho no exclusivo, irrevocable, mundial, permanente, ilimitado, asignable, con autorización para copiar, reproducir, traducir, adaptar, almacenar, publicar, mostrar, emitir copias o comunicar y/o usar, procesar o analizar “Su Contenido”, de cualquier forma que se conozca ahora o que se descubra en el futuro, y preparar trabajos derivados de, o incorporarlos a otros trabajos, sin necesidad de ningún otro tipo de consentimiento, notificación y/o compensación para usted.

Por la presente, usted acepta y autoriza irrevocablemente que “Service Club” ostente el derecho de usar y retener para sus propios fines, cualquier información suministrada por usted en relación con la “Plataforma”, y/o transmitir dicha información a cualquier otra empresa asociada o tercero interesado.

Al leer las presentes “Condiciones Generales” usted declara entender que nos facilita “Su Contenido” bajo el propio riesgo de su pérdida. Al proporcionárnoslo, usted declara y garantiza que tiene los derechos y/o permisos necesarios para facilitarlo; que no es confidencial y no viola ninguna ley, restricciones contractuales o derechos de terceros (incluidos los derechos de propiedad intelectual).

“Service Club” no tiene la obligación de revisar con antelación las comunicaciones ni la información, y no es responsable de la selección o el control de ningún “Contenido” publicado en la “Plataforma”, inclusive dentro del “Foro de Service Club”. Sin embargo, “Service Club” podrá revisar, editar o eliminar cualquier “Contenido” que, a su sola discreción, incumpla las presentes “Condiciones Generales”, incumpla las leyes, normas o regulaciones aplicables, que sea ofensivo o ilegal, o que afecte la reputación de “Service Club” o de su “Plataforma”, o que incumpla los derechos de los usuarios, o que dañe o amenace la seguridad de los usuarios. “Service Club” también podrá eliminar, a partir de la denuncia de un tercero, cualquier contenido que incumpla nuestros “Reglamentos comunitarios”. Asimismo, también se eliminará inmediatamente de Service Club al autor de cualquier contenido que esté en contra de nuestros Reglamentos comunitarios, pudiendo ser esta eliminación irreversible según la gravedad del incumplimiento. Si usted identifica que otro usuario publica este tipo de contenido, debe informar de inmediato a su ejecutivo de cuenta de Service Club.

 

7. GEOLOCALIZACIÓN

“Service Club” puede recopilar, usar y compartir datos relacionados con la ubicación, incluida la ubicación geográfica en tiempo real desde el ordenador o el dispositivo móvil del “Clubber”, solo si el “Clubber” lo ha autorizado previamente. Estos datos de ubicación pueden ser recopilados y utilizados por “Service Club” para mostrar la localización del “Clubber” en relación con la proximidad con la “Empresa”. Por ello y mediante la aceptación de estas “Condiciones Generales”, los “Clubbers” dan su consentimiento expreso para que sus datos de geolocalización puedan compartirse con las “Empresas” con el fin de garantizar el éxito del servicio. El “Clubber” optará por desactivar sus servicios de geolocalización en sus dispositivos de acuerdo con lo que se detalla en la Política de Privacidad.

 

8. OBLIGACIONES Y RESPONSABILIDADES DEL CLUBBER

Los “Clubbers” son totalmente responsables del acceso y el uso correcto de su perfil y cualquier otro contenido de la “Plataforma”, sujeto a la legislación vigente, ya sea nacional o internacional del país en el que se utiliza la misma, así como a los principios de buena fe, ética, costumbres y orden público. Específicamente, el usuario se compromete a respetar estas “Condiciones Generales”.

Los “Clubbers” deben abstenerse de usar su perfil y cualquier otro contenido de la “Plataforma” para fines ilícitos o para fines que dañen los derechos e intereses de terceros, o que puedan causar daños, deshabilitar, deteriorar o tener un efecto perjudicial en la ” Plataforma ”, su contenido y sus servicios. Asimismo, está prohibido impedir el uso o disfrute normal de la “Plataforma” por parte de otros “Clubbers”.

“Service Club” renuncia a cualquier responsabilidad editorial y declara expresamente que no se identifica con ninguna de las opiniones publicadas por los “Clubbers” en la “Plataforma”, siendo los “Clubbers” los únicos responsables de las consecuencias que puedan derivar de dicha publicación. En cualquier caso, y para proteger la reputación de la “Sociedad”, queda estrictamente prohibido que los “Clubbers” publiquen declaraciones despectivas o difamatorias sobre la “Sociedad”, la “Plataforma”, el personal de la Sociedad, la Administración, las “Empresas”, otros “Clubbers”, proveedores y distribuidores, y otras empresas relacionadas o partes interesadas. Dichas publicaciones pueden conducir al cierre de la cuenta o incluso al inicio de acciones legales.

Los “Clubbers” deben evitar las comunicaciones en las redes sociales que, directa o indirectamente, puedan malinterpretarse de forma que podrían dañar la reputación de la “Plataforma ” y la “Sociedad”. En este sentido, el “Clubber” promoverá en todo momento el mejor interés y reputación de “Service Club” a terceros. El “Clubber” no realizará actuación alguna que, en opinión de “Service Club”, pueda perjudicar la reputación y los intereses de este último. Esto incluye, pero no se limita a, hablar mal de “Service Club” a un “Cliente” o un tercero, en cualquier medio, ya sea a través de redes sociales, vía online, verbalmente o mediante correspondencia.

Aquellos “Clubbers” que no cumplan con estas obligaciones serán responsables de cualquier reclamación por daños y perjuicios. Bajo ninguna circunstancia, “Service Club” será responsable de cualquier daño o perjuicio que se deba al acceso o uso ilegal por parte de terceros. Cuando se hayan causado daños ​​por las declaraciones, acciones u omisiones de un “Clubber” que comporten la pérdida de ingresos de “Service Club”, el “Clubber” se compromete a compensar a “Service Club” en su totalidad.

El “Clubber” acepta y se compromete, a modo enunciativo aunque no limitativo, a lo siguiente:

  • Reconocer y actuar de acuerdo con el contenido del Manual del Personal y los Reglamentos comunitarios que están disponibles en los Sitios Web de “Service Club”.
  • No postularse o aceptar un empleo en “Service Club” sabiendo que está fuera de sus capacidades, ya sea por falta de conocimientos especializados o aptitudes.
  • Mantener la sección de disponibilidad dentro del perfil constantemente actualizada. Aunque se seleccione la opción “No disponible”, el “Clubber” podrá ver los empleos y postularse, pero su perfil no será visible para las potenciales “Empresas”. Si se selecciona la opción “Disponible”, recibirá ofertas de empleo de acuerdo con sus preferencias.
  • No alterar ni modificar, total o parcialmente, la “Plataforma”, ni cancelar, desactivar o manipular cualquier función o servicio de la Plataforma.
  • No infringir ningún derecho de propiedad industrial e intelectual ni las normas de protección de datos personales.
  • No utilizar la “Plataforma” para calumniar, difamar, intimidar o acosar a otros usuarios, o dañar su imagen. No acceder a las cuentas de correo electrónico de otros “Clubbers” o “Empresas”.
  • No cargar virus informáticos, archivos dañados o cualquier otro programa que pueda causar daños o alteraciones en “Service Club” o en el contenido y sistemas de terceros
  • No enviar correos electrónicos masivos a un gran número de personas, ni remitir direcciones de correo electrónico a terceros sin previo consentimiento.
  • No publicitar productos o servicios sin el previo consentimiento de “Service Club”. No utilizar la plataforma de “Service Club” para su beneficio comercial, para crear y comercializar su propio negocio o cualquier otro negocio.
  • No compartir su información (excluidos los datos de contacto) en el muro de noticias, sitios webs, redes sociales u otros medios de comunicación de “Service Club” con fines de marketing.
  • Resolver o negociar de manera amigable cualquier conflicto entre ellos y otros usuarios de la “Plataforma“, cuando sea necesario. “Service Club” se reserva el derecho, pero no tiene obligación, de monitorear las disputas entre los usuarios de “Plataforma“;
  • Responder a todos los correos electrónicos o notificaciones de “Service Club” de manera oportuna;
  • Asumir todos los riesgos asociados con el trato con otros usuarios de la “Plataforma”, con los que se pone en contacto a través de la “Plataforma”;
  • No utilizar la “Plataforma” para alojar, mostrar, cargar, modificar, publicar, transmitir, actualizar, distribuir, compartir, almacenar o destruir cualquier información o amenazar la unidad, integridad, defensa, seguridad o soberanía de cualquier nación, relaciones amistosas con estados extranjeros o de orden público o incitan a la comisión de cualquier ofensa reconocible o previenen la investigación de cualquier ofensa o insultos de cualquier nación;
  • No utilizar ningún otro dispositivo, programa, algoritmo o metodología automáticos, o cualquier proceso manual similar o equivalente, para acceder, adquirir, copiar o monitorear cualquier parte de la “Plataforma”, para obtener o intentar obtener cualquier material, documento o información, por cualquier medio que no esté disponible a propósito a través de la “Plataforma“.

El “Clubber”, en caso de tener constancia del incumplimiento de lo estipulado en las “Condiciones Generales”, podrá informar a “Service Club”. Todos los “Clubbers” también deberán informar a “Service Club” de cualquier abuso o infracción de estas condiciones por correo electrónico a través del “Formulario de Contacto”. “Service Club” revisará dicha notificación lo antes posible y adoptará las medidas que considere apropiadas, reservándose el derecho de retirar y/o suspender a cualquier Usuario de la “Plataforma” por el incumplimiento de las mismas. “Service Club” también se reserva el derecho de eliminar y/o suspender cualquier mensaje con contenido ilegal u ofensivo, sin necesidad de dar una advertencia previa o notificación posterior.

 

9. POLÍTICA DE QUEJAS

Todas las quejas relacionadas con “Service Club” deben enviarse a [email protected].

Revisaremos su queja el mismo día y trataremos de resolverla en un plazo de 48 horas.

Ciertas quejas pueden requerir una investigación detallada; en esos casos, le daremos alguna noticia en 48 horas y estableceremos, cuando sea posible, un nuevo plazo para responder.

 

10. SOLICITUDES DE EMPLEO Y CUMPLIMIENTO DEL “ENGAGEMENT”

Al solicitar un empleo o aceptar un “Engagement”, el “Clubber” se compromete a:

  • Completar todo el perfil y alcanzar por lo menos un nivel Master de su membresía.
  • Enviar todos los documentos necesarios para cada empleo.
  • Asegurarse de que toda la información y los documentos que se entreguen durante el proceso de registro sean exactos, legítimos y apropiados. “Service Club” se reserva el derecho de no aprobar un perfil o eliminarlo por completo si encuentra motivos para poner en duda la veracidad de la información o de los documentos, o si los considera inapropiados para el uso público.
  • Asegurarse de que cualquier actualización de la información y los documentos que se entreguen después del proceso de registro sean exactos, legítimos y apropiados. “Service Club” se reserva el derecho de no aprobar un perfil o eliminarlo por completo si encuentra motivos para poner en duda la veracidad de la información o de los documentos, o si los considera inapropiados para el uso público.
  • Responder con información veraz todas las “Preguntas para calificar” en las ofertas de empleo. “Service Club” se reserva el derecho de no aprobar una solicitud de empleo o eliminarla por completo si encuentra motivos para poner en duda la veracidad de la información o de los documentos que se entreguen durante la solicitud de empleo. Si consideramos que un “Clubber” envía reiteradamente información incorrecta en las solicitudes de empleo, nos reservaremos el derecho de eliminar de forma definitiva el perfil del “Clubber”.
  • Realizar los módulos de microaprendizaje disponibles en “Service Club Academy”.
  • Participar en las Competencias de “Service Club”.
  • Actuar de acuerdo con el contenido del Manual del Personal y los Reglamentos comunitarios. Si existiese información contradictoria entre el Manual del Personal y estos Términos y Condiciones, prevalecerán los Términos y Condiciones por sobre el Manual del Personal.
  • Llevar a cabo las funciones y responsabilidades necesarias que se detallan en las “Preguntas para calificar” en relación con la oferta de empleo y el “Engagement”.
  • No designará a ninguna otra persona para realizar el servicio.
  • Cooperará con las instrucciones de la “Empresa” y aceptará la dirección, supervisión y control de cualquier persona responsable dentro de la organización de la “Empresa”.
  • Obedecerá las reglas, políticas y/o regulaciones relevantes de la “Empresa“, incluidas, entre otras, sus políticas de salud y seguridad.
  • Cumplirá con el código de vestimenta y con el código de conducta de la “Empresa”, si los hubiere.
  • Actuará tomando las medidas exigibles para salvaguardar su salud y seguridad y la de todos aquellos que estén presentes, al igual que de aquellos que no estando presentes, pueden verse afectados durante la realización del “Engagement”.
  • Entiende que el servicio que se llevará a cabo se caracterizará por el siguiente Código de Ética:
    1. Servicio excepcional al cliente.
    2. Actitud amable y agradable.
    3. Actitud positiva y servicial.
    4. Honestidad e integridad.
    5. Rapidez y puntualidad

 

11. DECLARACIÓN DE IGUALDAD DE OPORTUNIDADES

12. SALUD E HIGIENE

Service Club” se compromete a cumplir con el más alto estándar de salud e higiene. Usted deberá notificar a “Service Club” o a la “Empresa” si ya ha sido contratado, si padece una enfermedad o infección que le impida trabajar con alimentos, de forma inmediata. Igualmente, garantiza que, durante el tiempo en que sufra de dicha enfermedad o infección, no solicitará la realización de ninguna tarea ni de ningún “Engagement” que requiera la manipulación o el contacto directo con los alimentos.

 

13. MEDIDAS DISCIPLINARIAS

En caso de incumplimiento de alguno de los términos de estas “Condiciones Generales”, el “Clubber” podría ser sujeto de actuaciones disciplinarias por parte de “Service Club”, pudiendo comportar la terminación de la relación contractual:

 

Problemas de desempeño en las funciones con la “Empresa”, incluidos, entre otros:

  • Incumplimiento de los objetivos establecidos.
  • Faltas de asistencia.

Faltas leves puntuales – incluye pero no se limita a -:

  • Comportamiento grosero.
  • Faltas leves en el trabajo.
  • Incumplimiento del código de vestimenta / política de puertas abiertas, etc.
  • Discriminación involuntaria.

Falta grave/Faltas leves reiteradas – incluye pero no se limita a -:

  • Falta de respuesta al asesoramiento y acciones correctivas.
  • Pérdida de formas frente a “Empresas”, clientes o socios.
  • Inobservancia de los estándares de salud y seguridad.
  • Tenga en cuenta que en algunos casos, la relación contractual puede terminar sin previo aviso por escrito. Un comportamiento inaceptable o una falta muy grave darán como resultado la terminación inmediata de la relación contractual. En cuanto a ejemplos de comportamiento inaceptables se incluyen los siguientes:
  • Corrupción / Soborno.
  • Incumplimiento de compromiso.
  • Hostigamiento / Discriminación voluntaria.
  • Violencia en el trabajo.
  • Malversación / Fraude.
  • Abuso de estupefacientes.
  • Violación de las políticas y procedimientos de la “Empresa”.
  • Lenguaje abusivo u ofensivo.
  • Enviar a otra persona en su reemplazo para realizar los trabajos que tiene asignados dentro de la Plataforma o por la “Empresa”.
  • Subir documentación falsa.
  • Cargar información, imágenes, vídeos o documentación inapropiados.
  • Cargar en la Plataforma imágenes, vídeos o documentación que sea perjudicial para la reputación de “Service Club” o alguna de sus “Empresas” (difamación).
  • Utilizar la Plataforma y el Foro de “Service Club” de manera tal que se incumplan los Reglamentos comunitarios.
  • Proporcionar información falsa.
  • Proporcionar el contacto de amigos o personas con las que no haya trabajado en el pasado como personas de referencia.

Asegurarse de que toda la información y los documentos que se entreguen durante el proceso de registro sean exactos, legítimos y apropiados. “Service Club” se reserva el derecho de no aprobar un perfil o eliminarlo por completo si encuentra motivos para poner en duda la veracidad de la información o de los documentos, o si los considera inapropiados para el uso público. Nos reservamos el derecho de informar a las autoridades competentes sobre la actuación del “Clubber”, según la naturaleza de la información o de los documentos

 

14. SITIOS WEB DE TERCEROS

La “Plataforma” puede incluir hipervínculos o enlaces a sitios web de terceros, cuyos sitios web están fuera del control de “Service Club“. Si hace clic en uno de estos enlaces, saldrá de la “Plataforma” y accederá a un sitio de terceros. El “Service Club” no verifica, supervisa ni respalda estos sitios web de terceros o los productos/servicios que están disponibles, publicitados o vendidos a través de estos sitios web de terceros y no acepta ninguna responsabilidad u obligación por la autenticidad, confiabilidad y exactitud de la información descrita en dicho sitio o cualquier pérdida o daño en el que pueda incurrir por su visita y/o transacciones/actividades en estos sitios de terceros. Usted acepta que accede a cualquiera de dichos sitios de terceros bajo su propio riesgo y asumirá únicamente todas las consecuencias asociadas con su acceso y uso de dichos sitios web de terceros. Dichos sitios de terceros pueden tener términos y condiciones y políticas de privacidad independientes y son independientes de “Service Club” y, por lo tanto, lea dichos términos de terceros antes de acceder a cualquier sitio de terceros.

 

15. PROPIEDAD INTELECTUAL E INDUSTRIAL

“Service Club” es propietario y el titular de la licencia que incluye todos los derechos de propiedad intelectual e industrial incluidos en la “Plataforma“, así como el contenido al que se puede acceder. Los derechos de propiedad intelectual o industrial de la “Plataforma”, así como todo el texto, las imágenes, el diseño gráfico, la estructura del navegador, la información y el contenido pertenecen a “Service Club”, que será el tenedor del derecho exclusivo de explotar estos derechos de cualquier manera, especialmente, los derechos de reproducción, distribución, comunicación pública y transformación, de conformidad con el Derecho Español de Propiedad Intelectual e Industrial.

La autorización otorgada a favor del Usuario para acceder a la “Plataforma” no implica la exención total o parcial, transferencia, licencia o cesión de derechos de propiedad intelectual e industrial por parte de “Service Club”. El contenido de “Service Club” y de su “Plataforma” no se puede eliminar, omitir ni manipular de ninguna forma. También está prohibido modificar, copiar, reutilizar, explotar, reproducir, comunicar públicamente, hacer publicaciones adicionales y posteriores, cargar archivos, enviar por correo electrónico, transferir, usar, tratar o distribuir de manera total o parcial todo el contenido incluido tanto en el “Service Club” como en su “Plataforma” para fines públicos o comerciales sin la expresa autorización escrita de “Service Club” y, si corresponde, sin la expresa autorización escrita del propietario de los derechos correspondientes.

Los “Clubbers” que comparten cualquier tipo de contenido u información a través de la “Plataforma” declaran que tienen los derechos necesarios para así realizarlo, con expresa renuncia de “Service Club” respecto de cualquier responsabilidad en relación al contenido o la legalidad de la información recibida. La puesta a disposición de contenidos por parte de los “Clubbers” a través de la “Plataforma” supone la cesión del derecho de explotación de la propiedad intelectual e industrial derivada de dichos contenidos a “Service Club”, de forma gratuita y en la medida en que la ley lo permita.

 

16. ACTUALIZACIÓN Y MODIFICACIÓN DE LA PLATAFORMA

Service Club” se reserva el derecho de modificar estas “Condiciones Generales”, la Política de Privacidad y la Política de cookies en cualquier momento y sin necesidad de previo aviso por lo que los “Clubbers” se comprometen a revisar las mismas de forma periódica. Los “Clubbers” deben leer atentamente estas “Condiciones Generales” antes de acceder a la “Plataforma”. En todo caso, la aceptación de los mismos es un primer paso esencial para acceder a los servicios y contenidos disponibles en la “Plataforma”.

Asimismo, “Service Club” también se reserva el derecho de, en cualquier momento y sin aviso previo, actualizar, modificar o eliminar la información contenida en su “Plataforma”, con lo que respecta a la configuración, presentación y condiciones de acceso, sin tener responsabilidad alguna por el resultado de esto. “Service Club” no puede garantizar que no habrá interrupciones o errores en el acceso a la “Plataforma” y a su contenido, ni el hecho de que esta tenga que actualizarse periódicamente. Sin embargo, “Service Club” llevará a cabo todas las acciones necesarias para corregir los errores, restablecer la comunicación y actualizar el contenido, a menos que haya motivos que hagan que sea imposible o difícil realizar la reparación, tan pronto como se reciba la notificación sobre el error, la desconexión o la necesidad de actualizar el contenido.

Por la presente, se acuerda entre las Partes que el “Clubber” no tendrá derecho a recibir ningún importe de “Service Club” como compensación por las pérdidas sufridas a consecuencia de la rescisión de este acuerdo, independientemente de las circunstancias que lo motiven.

 

17. EXONERACIÓN DE RESPONSABILIDAD

Usted acepta y tiene conocimiento de que la “Plataforma” y toda su información y servicios vienen dados en base a “tal como” y “según disponibilidad de” sin ninguna garantía o manifestación expresa.

Service Club” no se hace responsable ni realiza manifestaciones o ni garantiza que la “Plataforma” y sus servicios cumplan con sus expectativas, ni que su funcionamiento sea sin interrupciones o errores en el mismo. “Service Club” niega cualquier responsabilidad por cualquier tipo de error en su funcionamiento, imposibilidad de acceso o términos de uso no adecuados debido a equipo inapropiado, disturbios relacionados con los proveedores del servicio de Internet o la saturación de la red de conexión a Internet, o cualquier otra razón.

Service Club” no garantiza que la “Plataforma” o cualquier servidor mediante el cual usted accede a la “Plataforma” estén libre de virus o cualesquiera otros componentes dañosos. Cualquier contenido o material descargado u obtenido mediante el uso de la “Plataforma” queda bajo su propio riesgo y discreción y únicamente usted es responsable por cualquier daño a su sistema del ordenador o pérdida de datos que resulte de una descarga con tal contenido o material.

Service Club” no manifiesta ni garantiza que habrá un número mínimo de usuarios con currículum vitae o compañías con ofertas de trabajo en la “Plataforma”, ni que la información que los usuarios presentan en sus currículums o las compañías en sus ofertas de trabajo sean precisa, actualizada ni verídica.

Service Club” no manifiesta ni garantiza que ningún currículum, oferta de trabajo, noticias, publicidad o cualquier otro contenido o comunicación será visto por un número mínimo o definido de usuarios ni por cualquier usuario en específico, así como tampoco manifiesta o garantiza que los requisitos o expectativas sobre la calidad o cantidad de aspirantes a las ofertas de trabajo.

 

18. VIGENCIA Y EXPIRACIÓN

Las “Condiciones Generales” serán vinculantes desde el momento en que usted se registre y cree una Cuenta de usuario y continuarán vigentes hasta la expiración de su Cuenta de usuario.

Usted puede cancelar el uso de la “Plataforma” y la aplicación del presente Acuerdo por cualquier motivo o sin motivo alguno si accede a su perfil y lo elimina por completo.

Asimismo, “Service Club” puede terminar cancelar su actividad en la “Plataforma”, al igual que este Acuerdo por cualquier motivo o sin motivo alguno, que incluye, entre otros, una violación de las “Condiciones Generales”.

Tras la cancelación de su Cuenta de usuario, su derecho y licencia para acceder y/o utilizar la “Plataforma” cesa de inmediato; su identificación de inicio de sesión y contraseña se desactivarán y ya no podrá acceder ni utilizar la “Plataforma“. Además, su información personal será tratada de acuerdo con nuestra Política de Privacidad.

 

19. RESPONSABILIDADES DE SERVICE CLUB

“Service Club” actúa como intermediario entre los “Clubbers” y las “Empresas”. Básicamente funciona como una plataforma de mercado virtual que relaciona a diferentes profesionales de las industrias de la hostelería y los servicios de reparto con sus necesidades.

En virtud de lo anteriormente mencionado, “Service Club” no se hace responsable en ningún caso de los siguientes supuestos:

  • De cualquier disputa que ocurra entre la “Empresa” y el “Clubber”.
  • Del comportamiento de los “Clubbers”.
  • De la información falsa que los “Clubbers” o “Empresas” carguen en la “Plataforma”.
  • De la veracidad de la información y la autenticidad de los documentos cargados en los perfiles de los “Clubbers” o “Empresas”.
  • Del conocimiento y las aptitudes de los “Clubbers”. La formación que ofrece “Service Club” solo tiene la intención de funcionar como una referencia, y “Service Club” no tiene la responsabilidad de que el “Clubber” implemente los conocimientos adquiridos una vez que acepte el “Engagement”.
  • De los seguros comerciales que deberán proporcionar cobertura a los “Clubbers”.
  • De la responsabilidad de los “Clubbers” de tener los seguros obligatorios, como el “seguro por reparto de alimentos” o el “seguro por manipulación de alimentos”.
  • De los documentos vencidos, imprecisos o falsos que los “Clubbers” hayan proporcionado.
  • De la responsabilidad de los “Clubbers” de tener la formación obligatoria, como el “certificado de manipulador de alimentos”.
  • De cualquier comentario que los “Clubbers” o “Empresas” hagan en las redes sociales sobre su relación.
  • Del pago a los “Clubbers”, de las tasas y de otros gastos a los Clientes.
  • Del impago de los Clientes o cualquier otra infracción de los derechos laborales.
  • De cualquier accidente de los “Clubbers” en el desplazamiento al “Engagement” durante la realización del mismo.
  • De las acciones y operaciones de los “Proveedores Externos Recomendados”.
  • De cualquier acuerdo entre la “Empresa” y el “Clubber”.
  • De cualquier comentario o contenido que se publique en nuestro Sitio Web que incumpla las leyes, normas o regulaciones aplicables, que sea ofensivo o ilegal, o que afecte la reputación de “Service Club” o de la “Plataforma”, o que incumpla los derechos de los usuarios, o que dañe o amenace la seguridad de los usuarios.
  • De ninguna otra circunstancia expresamente mencionada en cualquiera de las cláusulas de estas Condiciones Generales.
  • Del incumplimiento de las normativas vigentes.

 

20. CONFIDENCIALIDAD

Con el fin de preservar la confidencialidad y los secretos comerciales de cualquier “Cliente” y de “Service Club” y sin perjuicio de cualquier otro deber, usted acepta que, durante y con posterioridad a cualquier “Engagement”, no divulgará (excepto en el desempeño adecuado de sus servicios durante “Engagement”) ni utilizará en beneficio propio o de terceros, ninguna “Información Confidencial”. Igualmente acepta que, en cualquier momento, no realizará copia alguna, extracto o resumen, ya sea en su totalidad o de forma parcial, de cualquier documento o información que pertenezca al “Cliente” o a “Service Club“, salvo cuando sea necesario efectuarlo en el transcurso de un “Engagement”, en cuyo caso dicha copia, extracto o resumen sería propiedad del “Cliente” o  de “Service Club“.

Usted se obliga a entregar al “Cliente” o a “Service Club“, al final de cada “Engagement”, los documentos, tarjetas de identificación, equipos, contraseñas, códigos de acceso y cualquier otro material que le pertenezca al mismo (con copias incluidas) y que se encuentra en su posesión.

También debe mantener de forma confidencial aquellos datos relativos a la presencia y a la conducta de aquellas personas a las que va a asistir con ocasión del “Engagement”.

La presente Cláusula no aplica a aquella información que es de dominio público, no siendo considerada como dominio público aquella información que se conoce debido al incumplimiento de la presente cláusula o debido al incumplimiento de cualquier otra obligación de confidencialidad, o aquella información cuya divulgación o revelación ha sido ordenada por Juzgados o Tribunales competentes.

 

21.CALIDAD Y MONITORIZACIÓN

Durante su proceso de solicitud, es posible que los operadores internos de “Service Club” lo llamen para una evaluación. Estas llamadas son grabadas y monitoreadas con fines de calidad y capacitación. Al solicitar un trabajo con la plataforma “Service Club”, usted acepta que sus llamadas sean grabadas. Si hay alguna razón por la que no desea que se grabe su llamada, dígaselo al operador que lo llama al comienzo de la llamada.

 

22. INDEPENDENCIA DE LAS CLÁUSULAS

Si cualquier término comprendido en las presentes “Condiciones Generales” se considera nulo o anulable, quedará sin efecto. Dicha declaración de nulidad no comportará la nulidad del resto de del Contrato, siendo el mismo aplicable y vinculante para las Partes.

En el caso de controversia entre las estipulaciones de las presentes Condiciones Generales y aquellas reflejadas en la Política de Privacidad, el orden de precedencia a aplicar será el siguiente: (i) las Condiciones Generales; (ii) la Política de Privacidad.

 

23. LEY APLICABLE

La relación entre “Service Club” y el “Clubber” se regirá e interpretará de acuerdo con las presentes “Condiciones Generales” así como de conformidad con la legislación española. Cualquier disputa que surja en relación con estas “Condiciones Generales” se resolverá con sujeción a la jurisdicción de los Jueces y Tribunales de la ciudad de Barcelona.
