Logistics Worker / User Terms and Conditions

1. Who these Terms apply to
- 1.1. By registering an account, clicking "Accept", "Agree", or otherwise accessing or using the Service Club Platform, the User acknowledges that they have read, understood, and agree to be bound by these Terms.
- 1.2. These Terms apply to any individual who accesses, registers with, applies through, trains through, purchases through, benefits from, redeems, claims, receives or otherwise interacts with any Service Club service, including Jobs, Academy, Micro Academy, Marketplace, Shop, Perks or any other current or future Service Club platform or service line, including drivers, couriers, delivery workers, warehouse workers, fulfilment workers, forklift operators, trainees, job candidates, candidates for future opportunities and other logistics workers (User).
- 1.3. These Terms apply regardless of how the User first contacted or applied to Service Club, including through the Service Club Platform, Service Club websites, Academy, Micro Academy, Jobs, Marketplace, Shop, Indeed, Meta, other job boards, social media, referral, WhatsApp, Telegram, email, telephone, events or any other online or offline channel.
- 1.4. Where the User purchases goods or services as a consumer, mandatory consumer rights that cannot be excluded under applicable law continue to apply. Where the User acts as a professional or self-employed person, the relevant B2B or professional rules may apply.
2. Service Club's role
- 2.1. Service Club operates a platform, marketplace, recruitment-support, training and related services infrastructure. Service Club is not the User's employer, hiring company, temporary work agency, payroll provider, transport operator, tax or social security adviser, immigration adviser, legal adviser, fleet manager or workplace supervisor.
- 2.2. Any employment, self-employment, contractor, onboarding, payment, dismissal, disciplinary, accident, workplace safety, immigration, tax, social security, shift, route, vehicle, facility or operational matter is between the User and the relevant Client, employer, fleet, platform, company or third party.
- 2.3. Service Club may introduce the User to Clients, training providers or other third parties, but Service Club does not guarantee that the User will obtain work, be hired, be onboarded, keep a role, pass a Client process, earn a specific amount, receive a particular number of opportunities or avoid accidents or incidents.
3. Account registration and eligibility
- 3.1. To register an account and maintain eligibility on the Service Club Platform, the User must:
- be at least 18 years of age or the age of legal majority in their jurisdiction;
- provide accurate, complete, up-to-date and lawful information;
- use their own identity and not create duplicate, false or misleading accounts;
- keep contact details and availability updated;
- hold any licences, permits, certifications, right-to-work evidence, vehicle documentation or insurance required for opportunities they pursue;
- not upload forged, altered, expired or misleading documents;
- not use the platform for unlawful, abusive, discriminatory, harassing, fraudulent or unsafe purposes; and
- comply with platform instructions, training instructions and these Terms.
- 3.2. Service Club may refuse, suspend, restrict or terminate access if it reasonably suspects fraud, false information, duplicate accounts, document misuse, unlawful conduct, unsafe behaviour, abusive communications, breach of these Terms or risk to the platform, Clients or other users.
4. Applications and job opportunities
- 4.1. The User may apply to specific opportunities or make general/spontaneous applications for future opportunities. Service Club may process the User profile, contact details, experience, availability, location, documents, answers, training completion and other relevant information to match the User with potential opportunities.
- 4.2. Service Club may share the User's information with Clients or other recipients where this is necessary for recruitment, matching, evaluation, onboarding support, training, reporting, compliance, fraud prevention, safety monitoring or other purposes described in the applicable privacy notice.
- 4.3. Service Club does not control the final Client decision to contact, interview, onboard, hire, reject, dismiss, pay, allocate work to or stop working with the User. Clients are independently responsible for their own recruitment, onboarding, employment, payment and workplace decisions.
5. Privacy, lawful basis and consent
- 5.1. These Terms are separate from Service Club's privacy notice. The privacy notice must explain who processes the User's personal data, for what purposes, on what lawful basis, with whom data may be shared, how long data are kept, what rights the User has and how the User can contact Service Club or lodge a complaint with a supervisory authority.
- 5.2. The User acknowledges that Service Club may process personal data where necessary for account creation, applications, training, communications, fraud prevention, platform security, service delivery, compliance and legitimate business interests. Where consent is required by law, Service Club will request consent separately, specifically and visibly. Consent may be withdrawn at any time, without affecting processing already carried out lawfully before withdrawal.
- 5.3. The User is not being asked to give an unlimited consent to share data "with everyone in every way". Data sharing must be linked to defined purposes, lawful bases and recipient categories, in accordance with the GDPR and LOPDGDD.
- 5.4. Where the User accesses, claims, redeems or benefits from Perks, discounts, benefits, vouchers, rewards, partner offers or similar advantages made available through Service Club, Service Club may process the User's personal data for the purposes of verifying eligibility, enabling access to the relevant Perk, managing redemption, preventing fraud or misuse, supporting customer service, reporting to the relevant Client or Perk Provider where necessary, and complying with legal obligations.
- 5.5. Such processing shall be carried out on the lawful basis identified in the applicable privacy notice, including, where relevant, performance of the relevant terms, legitimate interests, compliance with legal obligations or consent where legally required.
6. Contact by Service Club and Clients
- 6.1. Service Club may contact the User by email, telephone, SMS, WhatsApp, Telegram, in-app notification or similar channels for registration, profile completion, job applications, interview scheduling, document collection, training, reminders, Academy or Micro Academy services, Perks access, eligibility verification, redemption support, benefit-related operational communications, Shop or Marketplace transactions, support, account security, fraud prevention, complaints, service updates and other operational communications.
- 6.2. Clients that lawfully receive the User's contact details from Service Club may contact the User for recruitment, evaluation, onboarding, role-related, training-related or operational purposes. Clients are independently responsible for complying with their own privacy and electronic communications obligations. Promotional communications unrelated to the relevant opportunity require a separate lawful basis.
7. Training, Academy, Micro Academy, VR and AI-supported learning
- 7.1. Service Club may provide or coordinate training, Academy, Micro Academy, VR, behind-the-wheel, virtual, classroom, AI-supported modules, simulations, quizzes, knowledge checks and other learning content. Training is provided for learning and support purposes only.
- 7.2. Training completion does not guarantee employment, hiring, onboarding, safe driving, accident prevention, regulatory compliance, legal eligibility, Client acceptance or continued engagement. The User remains responsible for acting safely, complying with laws, following Client instructions and not using digital tools while performing safety-critical tasks.
- 7.3. The User must not use mobile, digital, VR or AI-supported training content while driving, cycling, riding a scooter, operating machinery, walking in unsafe conditions or performing any task requiring attention. Service Club shall not be responsible for accidents, injuries, fines, dismissals, losses or incidents caused by misuse of training tools, unsafe conduct, Client instructions, workplace conditions or third-party operations.
- 7.4. Where Virtual Reality (VR) training forms part of the learning content, the User must strictly adhere to all health, safety, and operational instructions, including taking mandatory scheduled breaks and adhering to rotating group participation. The User must immediately remove the VR headset and notify the trainer or platform support if they experience any nausea, dizziness, or physical discomfort.
8. AI, automated outputs and human decisions
- 8.1. Service Club may use digital tools, matching logic, AI-supported learning tools, automated reminders, knowledge checks or recommendation features. These tools are intended to support platform operations and training. Unless clearly stated otherwise, they do not make final employment, hiring, dismissal, disciplinary or work allocation decisions.
- 8.2. Where a Client uses Service Club outputs for its own employment or onboarding decisions, the Client is responsible for complying with applicable data protection, labour, AI and non-discrimination rules. The User may exercise data protection rights as described in the relevant privacy notice.
- 8.3. Where a decision is based solely on automated processing and produces legal or similarly significant effects, the User has the right to obtain human intervention, express their point of view, and contest the decision, in accordance with Article 22 of the GDPR and as detailed in the Service Club privacy notice.
9. User content and documents
- 9.1. The User remains responsible for any CV, document, image, video, message, answer, profile information, licence, certificate, identity document, right-to-work evidence, insurance document or other content uploaded or provided to Service Club. The User must ensure that such content is accurate, lawful, non-infringing and not misleading.
- 9.2. The User grants Service Club a limited right to host, copy, process, format, translate, transmit, display and share User content as necessary to provide platform, recruitment, training, fraud prevention, security and compliance services, subject to the applicable privacy notice and data protection law.
10. Content sharing restrictions
- 10.1. Service Club training materials, videos, screenshots, modules, VR scenarios, AI scenarios, quizzes, scripts, platform workflows, designs, images, software, databases and other content are protected by intellectual property rights, database rights and confidential know-how.
- record, copy, download, screenshot, scrape, reproduce, publish or distribute Service Club content except where expressly permitted;
- share training content with third parties, competitors, other platforms, employers outside the relevant training flow or public channels;
- sell, license, adapt, translate, modify or create derivative works from Service Club content;
- use Service Club content to develop, train, fine-tune or benchmark competing services, AI tools or training products;
- remove proprietary notices or confidentiality markings; or
- attempt to reverse engineer platform logic, source code, prompts, scoring logic or AI-supported workflows.
- 10.2. Breach of this clause may result in account suspension, removal from training, loss of access, deletion requests, legal action and claims for damages.
11. Fraud, safety and prohibited conduct
- 11.1. The User must not:
- provide false, forged, altered or misleading documents;
- impersonate another person or permit another person to use their account;
- create duplicate accounts to bypass platform rules;
- harass, threaten, discriminate against, abuse or intimidate Service Club staff, Clients, trainers or other users;
- upload malware, unlawful content or infringing material;
- circumvent Service Club to avoid fees or platform controls;
- misuse contact details received through the platform;
- misuse, transfer, resell, duplicate, manipulate, automate, scrape or fraudulently redeem any Perk, voucher, discount, reward, benefit, code or partner offer;
- create, use or allow duplicate, false or misleading accounts for the purpose of obtaining repeated or unauthorised access to Perks, benefits, discounts or rewards;
- use training tools while driving or operating machinery; or
- engage in conduct that creates safety, legal, reputational or security risk.
- 11.2. Service Club may investigate, suspend, restrict, remove, report or preserve evidence of suspected fraud, misuse, unsafe conduct or unlawful activity. Service Club may share relevant information with Clients, payment providers, platform providers, insurers, advisers or competent authorities where lawful and necessary.
12. No warranty and limitation of responsibility
- 12.1. The platform, opportunities, training and information are provided on an "as is" and "as available" basis, subject to mandatory law. Service Club does not warrant that the platform will be uninterrupted, error-free, virus-free, compatible with every device, or that every opportunity, Client statement, document, job description or third-party input will be accurate, complete or up to date.
- 12.2. Service Club is not responsible for Client hiring decisions, dismissals, non-payment, working conditions, accidents, injuries, vehicle issues, route allocation, shift cancellation, tax/social security treatment, right-to-work decisions, workplace safety, Client communications or third-party conduct, except to the extent mandatory law provides otherwise or the loss is directly caused by Service Club's wilful misconduct or gross negligence.
13. Marketplace, Shop, Perks and third-party services
- 13.1. This section applies where the User accesses or uses any Service Club marketplace, shop, perks, benefits, discounts, partner offers or third-party services made available through the Service Club Platform or related channels.
- 13.2. Where the User accesses Shop, Marketplace, Perks, discounts, benefits, vouchers, rewards, partner offers, third-party services, training providers, payment providers, Client platforms or any other third-party products or services made available through Service Club, additional terms, eligibility criteria, redemption conditions, expiry dates, availability restrictions or third-party rules may apply.
- 13.3. Perks may be provided, sponsored, funded, fulfilled or made available by Service Club, a Client, a Perk provider, a commercial partner or another third party. Unless expressly stated otherwise, Service Club acts only as a platform or facilitator for the relevant Perk and does not guarantee the continued availability, value, suitability, quality, legality, tax treatment, redemption, fulfilment or uninterrupted provision of any Perk offered by a Client or third party. Furthermore, the User acknowledges that coupons, voucher codes, discount codes, affiliate links, and tracking links may fail, expire, be rejected, be withdrawn, or change without notice.
- 13.4. The User must only access, claim or redeem Perks for lawful, personal and legitimate purposes and in accordance with the applicable eligibility criteria and redemption instructions. The User must not transfer, resell, duplicate, manipulate, misuse, scrape, automate, share access credentials, create duplicate accounts or otherwise abuse any Perk, voucher, code, discount, reward or benefit.
- 13.5. Service Club may suspend, restrict, cancel or refuse access to any Perk where it reasonably suspects fraud, misuse, ineligibility, duplicate accounts, breach of redemption conditions, unauthorised transfer, technical manipulation, abuse of the platform or any other conduct that may create legal, operational, financial, security or reputational risk for Service Club, Clients, Perk providers or other users.
- 13.6. Service Club is not responsible for third-party goods, services, websites, platforms, payments, warranties, availability, redemption failures, delivery failures, customer support, defects, cancellations, changes to offers or third-party content, unless mandatory law provides otherwise or Service Club is expressly identified as the direct seller or provider of the relevant goods or services.
- 13.7. Where the User acts as a consumer in connection with the purchase of goods or services, any mandatory consumer rights that cannot be excluded under applicable law shall remain unaffected. Where the User accesses Perks in a professional, employment-related or platform-related context, the User acknowledges that the availability of such Perks may depend on eligibility criteria determined by Service Club, the relevant Client or the relevant Perk provider.
- 13.8. The User acknowledges that Service Club does not provide tax or benefit classification advice. The User is solely responsible for declaring and paying any applicable personal taxes, social security contributions, or duties that may arise from claiming, receiving, or benefiting from any Perk, reward, or discount.
14. Suspension and termination
- 14.1. The User may stop using the platform at any time, subject to any ongoing transaction, training or legal retention obligations. Service Club may suspend or terminate access where the User breaches these Terms, provides inaccurate information, commits fraud, misuses content, behaves abusively, creates safety risk, infringes rights, breaches platform rules or where continued access may create legal, security or reputational risk.
- 14.2. Suspension or termination does not remove Service Club's right to retain information where necessary for legal compliance, dispute management, fraud prevention, security, accounting or legitimate record-keeping, as described in the privacy notice.
15. Liability
- 15.1. Nothing in these Terms limits liability where limitation is prohibited by mandatory law. Subject to mandatory law, Service Club shall not be liable for indirect, consequential, special, punitive, loss-of-profit, loss-of-opportunity, loss-of-data, business interruption or reputational damages.
- 15.2. Where the User acts as a consumer, mandatory consumer rights are preserved. Where the User acts in a professional or business capacity, Service Club's aggregate liability shall be limited to the amount paid by the User to Service Club for the specific service giving rise to the claim during the twelve (12) months preceding the event, or EUR 100 if no amount was paid, subject to mandatory law.
16. Changes to these Terms
Service Club may update these Terms to reflect changes in services, law, platform functionality, security, fraud prevention, business model or operational requirements. Material changes will be notified through the platform, website, email or other reasonable means. Continued use after the effective date may constitute acceptance, without prejudice to mandatory rights.
17. Governing law, complaints and jurisdiction
- 17.1. These Terms are governed by Spanish law. If the User acts as a consumer, the User may benefit from mandatory consumer jurisdiction rules. Otherwise, the courts of Barcelona, Spain, shall have exclusive jurisdiction, without prejudice to mandatory rules that cannot be excluded. Where the User acts in a professional or business capacity, before bringing any court proceedings, the parties shall first attempt to resolve any dispute in good faith or through an appropriate means of dispute resolution (Medio Adecuado de Solución de Controversias or MASC) in accordance with Spanish Organic Law 1/2025 and applicable implementing rules.
- 17.2. Complaints may be submitted through the contact channel indicated on the Service Club website or platform. Privacy complaints and data subject rights must be handled through the privacy contact details stated in the privacy notice.
